Hey, everybody. Happy Thursday. Good news. Dana's back tomorrow. She's coming back a day early. So we get to all hear Dana tomorrow. Yay. Also, great press conference this morning. I just got back from D.C. i was in D.C. this morning for the Epstein survivors. Epstein, Trump, bookmobile. Excuse me. Trump, Epstein, bookmobile. unveiling. there were Epstein survivors there. Senator Ron Wyden spoke, and they were all basically speaking out against the nomination of Todd Blanche for Attorney General. And speaking of that, there's still no deal with Cornyn. So there was a Wednesday morning meeting that got canceled because Cornyn is demanding a written rescission or at least an amended version of the slush fund and tax immunity that resulted from that fraud on the court collusion case between Trump and the I.R. uS. and apparently, the meeting this morning, Blanche didn't have the paperwork ready, so he can't. So Corin canceled it. Then there was, like, an emergency meeting with Coran and Tillis and the DOJ and some leadership in the Senate, on Wednesday afternoon, and they still didn't have it all together. Coryn, said he did, like, strike through red lines of the agreement that he wanted. and apparently the DOJ and Todd Blanche are still not willing to do that. Tillis seems a little more optimistic that this morning, Thursday morning, as you're listening to this, that they may be able to mark it up, in a way that satisfies everybody. I don't know. I'm sorry, I don't know what you're marking up. It should just be two sentences that the entire thing is rescinded. I don't understand what you're what changes you're making. It's not even a proper settlement. The judge told you, for legal purposes, you can't consider it a settlement. So there's really nothing legally to mark up. Unless you're just giving away. It's bizarre. but Cornyn is holding the line so far. He could cave. But remember, even if they don't, confirm him, Todd Blanche still gets to be the acting Attorney General for as long as he wants. Because of the Attorney General Succession act, there's no time limit on acting attorneys general, so we're all sort of waiting, for that. But this also could postpone the committee vote tomorrow. It may go forward. It might not. But that would buy Judge Sullivan some time to review those Epstein redactions in the Katie Fang lawsuit that Todd Blanche is supposed to hand over to the court today, Thursday, as you're listening to this, they're due July 30th. He could just blatantly defy that court order, or he may hand this stuff in. And it might take Judge Emmett Sullivan. Did I say Reggie Walton is Judge Emmett Sullivan? It might take Judge Emmett Sullivan. A couple. August 6th, we're supposed to get DOJ internal communications about the New York Times journalist subpoenas where they lied to a magistrate judge to get those warrants executed. Those subpoenas executed against reporters from the New York Times and their family members for, guess what, phone records from a third party, which is what the Republicans are super pissed at Jack Smith about. They're doing what they got mad Jack Smith about. It's just. It's bizarre. And they're trying to indict him about it for lying to Congress, which he didn't do. Also, Dr. Anthony Fauci invoked his Fifth Amendment right to not answer questions over at a contentious Senate hearing about the origins of COVID Why they think, I tell you why. They want to bring back Covid because they would rather talk about COVID than anything else that's happening right now, even though it's probably politically bad for them. But they were probably like, well, you know, gosh, everything's really terrible. Everybody hates us. What's one thing that our rabid, frothy idiot base really gets their panties in a twist about? It's Dr. Fauci who, you know, I think I put up on social media earlier. Dr. Fauci told us all to wear masks during a global pandemic while RFK Jr collects raccoon penises. But, okay, it's just. It's so bizarre to me, but it's also meant to be a massive distraction. And you know, Senator Moreno of Ohio, Bernie Moreno, whose son in law beats his daughter and throws boiling water on her and held a gun to her head. When asked about that, he said, I just hope she's safe. But then comes out to tell and says to Dr. Fauci, who the fuck do you think you are? Actually said that like, he's a public servant, you weirdo. He's an 85 year old retired public servant. Why aren't you subpoenaing Mitch McConnell's 84 year old ass to make an appearance on Capitol Hill? Anyway, it's just a clown show. Also more clown show shit. Senate Republicans confirmed Jay Clayton as top, he was the top federal prosecutor in the Southern District of New York who could be implicated, by the way, in this Judge Subramanian New York Times subpoena saga. Because that all happened in the Southern District of New York. But he's now the new head of US Intelligence at the office. Director of National Intelligence. He's the Director of National Intelligence. They've made him the dni, the guy who can't say that Joe Biden won the 2020 election and he was going to get some Democratic votes, but after he refused to do that, not a single Democrat, even Fetterman voted for him. so it was a party line vote, 51 to 47. 47 Dems, 51 Republicans. Two Republicans didn't vote. That's Darlene, Nardone, who has changed her name officially to Graham by the way, for the name recognition. And of course Mitch McConnell. And with that he is now the Director of National Intelligence. And today the Senate actually adopted a non binding resolution opposing a pardon for Ghislaine Maxwell that was by unanimous consent, so nobody objected. So it was unanimous. it's non binding because it can't be binding because Congress doesn't have the constitutional authority to usurp the President's pardon power. but they can come out and condemn a pardon. And they did so today by unanimous consent. That's nice, that's good. But better would be to not confirm Todd. Blanche, how can you, out of one side of your mouth be like, no, pardoning Ghislaine Maxwell would be a bad thing. But on the same hand, plan to vote to confirm the guy who sat down with Maxwell and moved her to a low security prison. The guy who's probably brokering a pardon for Ghislaine Maxwell. Todd Blanch. I just, it doesn't make any sense. So yes, that's good. Unanimous consent, condemn, joint resolution. You know, a pardon would be bad, but, but covering up for her is fine. And you can actually be the Attorney General if you do that. Just whatever. Oh, I can't wait till the midterms. All right, everybody, we have a ton of news we have to get to today, so let's hit the hot notes. Hot notes. All right, first up from Ms. Now, former FBI Director Jim Comey asked a federal judge Tuesday to dismiss the Seashells case alleging vindictive and selective prosecution and claimed that Trump compelled the U.S. secret Service to surveil him after he posted on social media a photo of Seashells on the beach. In the motion to dismiss the case filed late Tuesday, Comey's lawyers argued that the Seychelles case, quote, is not based on a good faith application of the law and the facts, but instead effectuates a, ah, years long campaign by the President to use the criminal process to punish Comey for his protected speech. And because of the President's deep seated animosity, the indictment is the second brought against Comey in the last 12 months. The first was dismissed because the sole person to sign the indictment for perjury was disqualified as a U.S. attorney. He filed a, vindictive and selective prosecution motion there, along with a few other pre trial motions to dismiss, but we never even got to those because I, think it was Halligan who was disqualified. Now this latest filing further alleged that the US Secret Service knowingly conducted illegal electronic surveillance of Mr. Comey at the request of a high level official. Comey's brief specifically claims the Secret Service was sending frequent updates to Air Force One about its investigation of Comey. And at Trump's request from the jump, Comey then alleges that although Secret Service supervisors made it clear that electronic surveillance was a bad idea because there was no indication of any imminent danger to life. To justify the warrantless surveillance, the Secret Service ultimately requested tracking of Comey's cell phone the day after his Instagram post as a request to the Justice Department's unnamed number three person. Unnamed number three person. Sounds to me, and this is just a guess, like Emil Bovey, who now sits on the Third Circuit Court of Appeals. Comey further alleges that the surveillance was conducted as he and his wife drove Back to Washington D.C. from North Carolina, including as they stopped to visit the grave of their deceased son. The motion to dismiss the case for selective and vindictive prosecution was accompanied by multiple other pretrial motions, including requests to unseal grand jury Audio recordings due to alleged irregularities in the prosecutor's presentation of the case. That sounds familiar. And to suppress certain evidence on the grounds it was obtained through intentional misrepresentations and omissions. Oh, that also sounds familiar. Comey also submitted a declaration from famed Mafia prosecutor and former federal judge John Gleason, who attests that in his experience, the handling of organized crime cases, 86 in no way means murder. There's a lot more to this, including information that the DOJ searched the entire Gambino case file for references of 86 and found none. Trump's got it in his head that the mob used to say 86, 86 him to whack a guy. And so they went through the entire Gambino case file and found no mention of 86. They also found 210,000 items for sale on Amazon that have 8,645, 8,646 or 8,647 on them. So this is just, bonkers. And one of the main reasons they want to look at the grand jury materials, as well as what we mentioned before, was when Kash Patel said in a press conference, he told the press what the grand jury was told. He said to the press, the grand jury was told that Comey apologized for the 8647 post. You're not supposed to talk openly about what goes on in the grand jury. So we might get to see what this grand jury did. That'll be interesting. And again, I know that this goes against everything decent and holy and lawful and fiscally responsible, but, man, I would love to see this go to trial. I would pay to see this trial. I mean, I know they don't televise him, but, you know, my gosh. All right, we're going to go over all of this Comey stuff, all of his motions this week, and go into a little bit more depth on the next episode. This weekend's episode of Unjustified. Also from msnbc. Last week, former Justice Department lawyer Liz Oyer. I love her. Testified in the Senate against Todd Blanche being nominated for Attorney General. Then came the death threats. Oyer oversaw the DOJ's pardon office before Trump ousted her and promptly turned the office into a tool to help out his donors, political allies. She has said she was fired for refusing to restore Mel Gibson's gun rights after his misdemeanor conviction for domestic violence, a, claim that the Trump administration denies. And she was a key witness urging senators to vote against confirming Blanch, who's already sought as acting Attorney General to quash further inquiry into the Epstein files and drew criticism over his softball interview with convicted sex trafficker Ghislaine Maxwell. And it seems Republicans are now fueling attacks against Oyer as they try to make Blanche the nation's top law enforcement official. Quote, hey, everybody, I started getting death threats after I testified against Todd Blanche last week. That's what she said. Showing images of expletive laden messages that she received. Oyer attributed these threats to dubious accusations peddled by Missouri's Republican senators Josh Hawley and Eric Schmidt and in conservative media that she was basically an ally to rapists and murderers. All right, let's talk about ICE for a minute. And content warning for racial slurs from abc. Federal immigration agents carrying out enforcement in Los Angeles last summer used racial slurs to refer to Latinos. That's according to body cam footage and text messages released in recent court filings. The ACLU of Southern California included blurred and redacted body camera footage and forensically recovered text messages as part of a motion for preliminary injunction seeking to end what they call federal agents pattern of race based profiling when conducting stops as part of the Trump administration's crackdown. Quote, yeah, just plug us in wherever you see some tonks and we'll jump out. That's what one agent can be heard saying in a video released in court. Tonk is considered a derogatory term used by agents that denotes the sound that an immigrant's head makes when struck by a flashlight or a baton. Quote, there was a guy, I'm pretty sure he's a wet, and he was just sitting in that minivan. That's what an agent can be heard saying on another video using a term that's allegedly a shortened version of a slur to refer to Latinos. A spokesperson for the Department of Homeland Security didn't respond. Instead, they said, our agents are focused on protecting the American people, not entertaining performative outrage. Wow. The ACLU filed a lawsuit last year on behalf of Several individuals, including U.S. citizens who were stopped, questioned, and in some cases, detained by immigration agents. In the Central District District of California, U.S. district Judge Mame Iwusi Mensah. Frimpong. she issued a temporary restraining order barring stops based solely on the basis of race. But the Supreme Court later lifted those restrictions. That's what the Kavanaugh stop is. Quote, this filing should shock the conscience. That's Myra Joachim, Deputy Director of immigrants rights, ACLU, SoCal. and she said that of these court documents and went on to say, evidence gathered from the government has confirmed what our communities have known all along. Immigration officers are flagrantly violating the law by detaining people without justification and often primarily because of the color of their skin. In addition to body cam footage, ACLU attorneys filed copies of text message chains, quote, some of these people are stupid. Why would you post on social media that you're wet? That's what one agent asked, according to the filing. And here's another one. BTW, tonks everywhere selling food for the 4th festivities in Long beach right now. That's what another one added. Next up in a related story from NBC, a federal judge Monday ordered immigration authorities to release a key witness in the fatal shooting of a Mexican home builder by U.S. immigration and Customs Enforcement in Houston. U.S. district Judge Keith Ellison ordered the release of Jose Trinidad Rojas Pilego. That's from, that's one of the people who was in the van with Arujo who was shot in Houston. And Judge Ellison is ordering his release from ICE custody within 48 hours after the judge previously blocked his deportation. Ellison agreed with Rojas Pelago's argument that his detention violates his Fifth Amendment due process rights. Hugo Valderras Ibarra, who's an attorney for Rojas Pilego, did not immediately respond to requests for comment. Rojas Pilego, as I said, was one of three passengers in a van driven by Lorenzo Salgado Arujo. When Salgado Arujo was shot by an ICE officer during a traffic stopped, all three passengers were taken into ICE custody. Remember they were trying to force him to self deport so they couldn't be a witness. Well now that one of them's been ordered released, the Department of Homeland Security said shortly after the shooting that Salgado Arujo had, quote, weaponized his vehicle in an attempt to run over an ICE law enforcement officer and that the officer fired in self defense. But Rojas Pelago and other another passenger wrote in statements submitted in court that the officers were at the sides of the van and never in front of or behind it. Roxas Bellego described the government's account as a lie. Salgado Arujo, the 52 year old father of three, had been living in the US for 35 years and was close to obtaining legal status. According to his family. He had no known criminal record. His killing, one of at least 10 during immigration enforcement operations since the start of Donald Trump's mass deportation campaign, sparked widespread protests in Houston and calls for an independent investigation. Rojas Pelago has entered the US Decades ago and had not gained legal status, according to his stepdaughter. He has a pending application for a U visa, which is a special legal status for victims of certain crimes who have suffered physical or mental abuse and have assisted law enforcement, according to a judge's order. If granted, he would receive a four year work permit, protection from deportation and a path to a green card. If immigration agents seek to detain Rojas Pelago again, they are now required to notify the judge and hold a pre detention hearing. Next up from the Arizona Mirror A Republican ballot referral that sought to amend the state's constitution to put the state's largest teachers union out of business was tossed off the ballot Tuesday after a judge concluded that it would have outlawed all public sector unions. And that violates Arizona's constitution's separate amendment rule, which demands that proposed constitutional amendments be limited to a single action. That's according to Maricopa County Superior Court Judge Gregory Como. The legal challenge to House Concurrent Resolution 2040 centered on sweeping language tucked in the measure that Comeo said goes far beyond barring school districts from working with unions for its teachers and other workers. The provision stated that, quote, this state or any political subdivision of this state boilerplate language commonly used in legislation intended to comprehensively ban governments from doing something may not negotiate with labor organization, an exclusive representation agreement, collective bargaining agreement, memorandum of understanding contract or other agreement regarding the terms and conditions of employment. Senate President Warren Peterson, who's running to be Attorney general, and House Speaker Steve Montenegro argued that the language needed to be read in context of the larger measure, which was all about school districts and their employees. But Cuomo said that interpretation is hogwash. The judge said the court finds no ambiguity in the phrase this state or any political subdivision of this state may not negotiate with labor. That's what he wrote, adding that the HCR's own definition of labor organization is broad. Far from limiting the term to teachers unions or school employee associations, the definition doesn't even mention such organizations. The judge noted that while some of the HCR does single out unions for teachers and other school employees, when it begins to speak to contracting with local governments, it shifts to that much broader language. Quote, it flatly prohibits the state of Arizona or any local government from contracting with any Labor Union. HCR 2040 was crafted by Republican lawmakers as a retaliatory measure aimed at Arizona Education association because of the union's ballot referral to reform and regulate the state's universal school voucher program it was at the center of a last minute negotiation between Republicans and the teachers union at the end of the legislative session where Republicans had allegedly promised to drop the union busting ballot referral if certain reforms to the ESA program were passed. In turn, the AEA would have dropped its measure. Those negotiations, though, fell apart and Republicans ended up sending HCR 2040 to the ballot. After the Arizona Mirror reported on how it could potentially bar all public sector unions, including police and fire unions, the AEA filed a lawsuit that challenged the ballot measure and said it violated the separate amendment rule. The court ultimately sided with AEA that the measure violates the separate amendment rule of the Arizona Constitution. In his ruling, Como wrote that taking out the offending language was not an option. Quote, when a proposed ballot measure violates the separate amendment rule, severance of the offending of the offending provision is not an option. The entire measure fails. Now Kim Quintero, a spokeswoman for Arizona Senate Republicans, said they're not going to appeal this ruling, so it will not be on the ballot. So congratulations Arizona. Well done. As a liberal progressive in a deeply conservative part of Texas, I've started to notice some of the Trump and MAGA signs are coming down. I'm also hearing more people ask why we supposedly need to take Texas back when Republicans have controlled the state for roughly 30 years. Rest in peace, Ann Richards. Every morning, I take my dog, Scout, aka Ms. Boots, aka Scooty Booty to the park. And we put it, by the way, if you have a chain of different names and nicknames for your pet, we want to hear about it. We put in our 1 mile loop, get our steps, and listen to you explain what's happening in the world. With all the swearing one podcast can reasonably accommodate. And I usually swear right along with you. I really love this idea because taking a walk in the morning, just, you know, whether you're listening to the beans or not, it's just I listen to the Martin Sheen podcast. I'm obsessed with that podcast. it's just so, it does a lot for your day. it's hard to explain. For, my pod pet tariff, I'm including a picture of Ms. Boots. And you're welcome to guess her breed, because I still have not managed to figure it out myself. I'm also including a glimpse of some of our native Texas wildlife. We have an albino deer who visits and eats apples, the apples we leave out for the animals. Watching her is one of those small reminders that life's pleasures can sometimes be beautifully simple. Admittedly, the first time I saw her, I thought it was hallucinating. I cannot adequately express how much your podcast means me. You make the news more understandable, more bearable, and somehow even funny when the circumstances are anything but. Please do not ever stop doing what you do. Pronouns, he and him, Dear Allison and Dana and all the ships at sea. Last week, a group called us before them posted billboards in Lima, Ohio, attacking Kiz Lima. Lima, Lima. I can't remember. I know it's one or the other. Attacking kids. Oh, yeah. With two moms or two dads. Local activists like MyGayDay.org and Ohiopride.org raised money to buy billboards supporting kids with two moms and two dads. They hoped for $500, but they raised 18,000 plus in just days. And there are now billboards in various cities in Ohio standing for queer families. They also called for a rally Monday evening in Lima, Lima to support action in the city council. I drove three hours and brought several of my big pride flags to share. About 50 people showed up on very short notice. People driving by were mostly supportive. Few trucks blasted by. But I think they were afraid the big pride flags would cause their truck nuts to fall off. One attendant was Sir Logan the Avalanche, who showed up in full plate armor to demonstrate his willingness to defend queer families against all comers. The story of how the ruins got to this park is fascinating and a great example of how people from all walks of life can do, what they can, what they can to promote the common good.
