happy to be back. Thank you for covering me. I have a couple of business events this week, and so Allison is sort of popping in while I'm popping out, and then I'll be back the next day, and that's gonna happen again tomorrow, so thank you.
Well, every time you go away, you take a piece of me with you. Doo doo, doo, doo, doo. Anyway, lots going on this week and lots going on today. We don't have the best of news for you today. We do have a kind of an uplifting story about a, you, the DOJ going 0 for 20 on voter rolls, but not a good day for LGBTQ rights.
Yeah, I know, and I hate to say that I don't think it surprises anyone. We were told between now and the midterms, it's going to get even worse. You know, we were told that a year ago, and they're proving it. They are afraid they're going to lose certain powers, if you will, if everything goes as planned on our side. And it looks like if we can stop all their shenanigans, that it will. And they are going to try and break as much as they can before the midterms.
Yeah, agreed. And speaking of midterms, we got some primary elections going on, like, as we record this.
I'm looking forward to seeing what's happening, too. Let's see, we've got Michigan, Virginia, Kansas heading to the polls Tuesday to vote in the primaries. And we're recording this. As we're recording this, polls have not yet closed, so we're going to go over the results with all of these things tomorrow.
Yeah. And of course, Todd Blanch took a major step toward confirmation as Attorney General Tuesday after the Senate Judiciary Committee voted 12 to 10 right along party lines to advance his nomination, likely setting up a final vote within days. Now Susan Collins has come out and said she's going to vote no. And this generally happens like Republican senators in swing states who might be up for election or, you know, might actually take a stance, are allowed to vote no so that they can still confirm him. She's a no. I'm imagining Murkowski will be allowed to vote no, but not sure exactly. We'll see who they'll let vote no, but it won't be enough people to stop his confirmation.
It's true. That's true. And by the way, speaking of that, Politico reports that Todd Blanch faith leaders on a private call that he was preparing to take action to roll back abortion access nationwide. Such a. On a recording of the call posted online Thursday by the religious group, I almost said incesters, which would have been maybe appropriate. Intercessor. Inter. Intercessors. Why? What is that word?
yeah, intercessors. I. I don't know what that is.
All right, I don't either. Intercessors for America, everybody. And if you know what that is, let us know. And by the way, that was hosted by the White House faith office, whose leader is a banana pants. And apparently Blanche lamented that the Trump administration's efforts to restrict abortion are taking longer than we want, but said the Justice Department was, and I quote, working hand in hand with federal health agencies and the White House, and I quote, so that Dobbs decision becomes permanent in every single state.
Yeah, Dobbs was the decision that overturned Roe v. Wade, so that's gross. What's interesting is, though, that that intercessors, whatever Scissor Sisters, took, they took their.
How dare you. Do not insult the Scissor Sisters.
Yeah, you're right. They're nothing alike. They took down that post, by the way. I'm assuming they got a heated phone call from Todd, Blanche, and said, hey, take that down. You're making me look bad. I got to get confirmed. But, yeah, Collins is a no, so we'll keep an eye on all of that for you. But we do have a lot of news to get to today, so let's hit the hot notes. Hot notes. All right, let's shift our focus from the Senate to the House. From the Guardian, Max Miller, a U.S. republican representative from Ohio. I think he's in the 7th district. Is facing a rising groundswell of resignation calls from his own party over domestic abuse allegations after his ex father in law, Bernie Moreno, a GOP senator, said he was unfit to serve in Congress. With a deadline looming for party leaders to choose a potential replacement. You know how they had to do with Graham Platner because of deadlines? Max Miller, a former White House aide, also came under pressure from Trump on Monday after the President reportedly called and told him things aren't looking good for his reelection campaign against his Democratic opponent, Brian Poindexter. Earlier in the day, Miller said he would request an ethics investigation into himself.

To clear my name from these horrific attacks on myself and my family, adding, I have absolutely nothing to hide. That's why you hid the tape recorder when you recorded your conversations with you and your ex wife. Pleas for Miller to step down intensified after Moreno, the father of Miller's former wife, Emily Moreno, broke his silence after months of refraining from comment on the allegations. By the way, which is disgusting. A series of public statements from Moreno's fellow Republican senators indicate that their sympathies are with him. Quote, miller should resign. He should quit. That's Senator Roger Marshall from Kansas. He told that to Politico and went on to say, I don't know Mr. Miller's story, but I trust Bernie Moreno. So, he's a good friend and is a good family. He's got high value. So I don't listen to the women, but Bernie, I'll listen to that. Jesus. West Virginia Senator Shelley Moore Capito. I don't know if that's how you say it, Said, I don't know Miller. I haven't read a whole lot about him. But if Moreno thinks he ought to resign, I'm supportive of that. Again, they support the man. Lisa Murkowski, a Republican senator from Alaska, said the accusations are very serious. And if there's truth to them, I am one who says that our elected officials need to be held to higher standards. And certainly when it comes to allegations of domestic abuse, child abuse, that's not what we want in our lawmakers. So I guess she actually knows who he is. And read up on what's going on. Three other senators, Rick Scott of Florida, West Virginia's Jim justice, and Cynthia Loomis of Wyoming, also gave public backing to Moreno against Max Miller. And Ms. Now is reporting that former White House press secretary Stephanie Grisham filed for a temporary restraining order against Max Miller. That's according to her attorney. Mark Zaid, one of her attorneys. Grisham and Miller dated in 2019 and 2020, and they've been involved in a separate legal battle after Grisham published a 2021 op ed in the Washington Post describing an abusive relationship with her boyfriend, who was at the time a White House staffer. Now, Grisham didn't disclose the name of her boyfriend. That could have been anybody in the Trump White House in 2019 and 2020. Yep. While Grisham didn't disclose the name of her boyfriend, Miller sued her for defamation. Isn't that crazy? Like, when that is wild Ford worker was like, you're a pedophile. And Trump was like, you're talking to me, right?
Like, yeah.
and then said, you, my boyfriend was abusive. You must mean me, the man who abused you and sued her for defamation hours after the op ed was published and denied any allegations of abuse, even though he raised his hand saying, you must be talking about me. At the time, Miller was running for his House seat in Ohio's 16th congressional district. Miller later dropped his defamation lawsuit against Grisham, and both parties signed a non disclosure agreement that noted they would not speak about each other in disparaging ways. Now, we don't know the basis yet for this temporary restraining order, but it may have something to do with maybe Max Miller violating that agreement. I have no idea. I really don't know what it's about yet. And in a related story from Politico, the House Ethics Committee recommended Monday that lawmakers censure Rep. Chuck Edwards for engaging in, quote, persistent, unprofessional and inappropriate conduct towards two young female staffers, cataloging multiple episodes of sexual harassment by the married lawmaker. Democrats, on the other hand, are calling for him to resign. And some of these incidents of sexual harassment are so disgusting, like calling women like sweetheart and hot stuff and, you know, taking his staffers out for like one on one dinners and commenting on the weight of some of his female staffers. Just a nasty piece of work, this guy.
Yeah, yeah. Piece of garbage. All right. This is from Tallahassee Democrat. The Tallahassee Democrat. Florida's law that was meant to prevent children from attending and I quote, sexually explicit drag shows it doesn't violate the First Amendment. That's according to a majority of federal appellate judges who weighed in on the contentious measure. The case now heads back to trial court in Orlando. The appeals court struck down what's called a preliminary injunction and prevents enforcement of the law while the case is pending, saying that the plaintiff, the Hamburger Mary's Restaurant of, Orlando, and I quote, failed to establish a substantial likelihood that. That it would ultimately win its case. On Aug. 4, an 8 to 5 majority in the 11th U.S. circuit Court of Appeals agreed that the state law was constitutional. Critics had warned its enforcement imperiled the free expression of LGBTQ and drag communities. Now, the crux of the argument is whether the law violated the First Amendment by threatening the free speech rights of patrons of venues who wish to host drag performances. Hamburger Marys further argued that the law was vague on what performances were prohibited. Although the law does not name drag shows, critics have widely viewed it as a law meant to combat drag, a recognized art form that's roughly defined as dressing up as the opposite sex, but also has a history of political commentary and activism. And I quote, in any event, the act is consistent with the legislative intent to target drag shows that are obscene for children, not drag shows writ large. That's what. That's what the Circuit judge, Andrew Brasher, said. And by the way, he's a Trump appointee, okay? He's the one that authored the majority's opinion. The opinion comes after oral arguments in June and months after the federal appeals court struck down the lower court order, which suspended enforcement of the law in question for years. On December 1, the court said, without reasoning, that it would take up arguments on the constitutionality of the state law. Some judges who sided with the majority still noted arguments they disagreed with, and the dissenting judges wrote scathing opinions as to why the court's order was contrary to the constitutional principles. Circuit Judge Robin Rosenbaum said her colleagues were embracing and I quote, mess around and find out, or they like to call it mafo First Amendment jurisprudence. She added that the state intentionally created the statute to chill drag and that the vague language serves as an especially pernicious club to silent political speech. And another quote, under this form of jurisprudence, a citizen can learn whether a law prohibits their speech only by taking a wild guess, presenting their speech, and then seeing if they get arrested and face imprisonment, thousands of dollars in fines, and loss of their business license. That's what Rosenbaum wrote, who was appointed by Barack Obama. Melissa Stewart, who represents Hamburger Marys of Orlando, said in a statement that the court, and I quote, held that the state may target speech it dislikes and strip PA parents of their right to determine what is appropriate for their own children. Quote, we believe that the First Amendment's protections are more robust than that. This is what Stewart said. This litigation is not over, and we will continue fighting to protect free speech in the State of Florida. And there's a related story to this from Raw Story. In Washington state, voters are going to decide the fate of a ballot initiative that would require girls from kindergarten through high school to undergo sex verification testing before playing school sports. This is a measure critics call the most extreme of its kind in the country. And it's fucking disgusting. Now it's IL 26638 would bar transgender athletes from girls teams by mandating that a healthcare provider certify a player's sex assigned at birth using genetic screening, testosterone testing, or an examination of reproductive anatomy. Again, these are kindergarteners. As part of the annual sports physical every young athlete already undergoes. That's reported by the Cut. This is a. Quote, the measure was clearly not written by someone who practices medicine. This is what Dr. Gina Martin said. And Gina's a family medicine physician who offers sports physicals to her patients. And I quote, physicals focus on the two most important aspects of sports. First, muscular skeletal health, thinking about kids, joints, bones, muscles and tendons. And then cardiac health, looking into their heart health and finding out if we need to screen for additional cardiac risk factors. Quote, what is certainly not medically necessary is for me to do an exam and confirm somebody's sex either through hormone testing, genetic testing or non indicated genital exam. Martin added, I don't even know how it would work because I've never run those tests on a patient. The measure doesn't specify, by the way, who, would perform the exams, who would pay for the exams or how schools would carry them out, leaving open ended questions about whether young girls could be required to disrobe potentially in a group setting where many schools currently offer free physicals. And I also want to point out that young boys are also molested and hurt in this country. And so if this is just, this isn't just specific to young girls. And I would be shocked if people don't have a problem with their five year old little boy also having their genitals checked to make sure it's a little boy. If maybe they have long hair when they go to school.
But doesn't it also give pedophiles an excuse to get a bunch of naked kids in a room?
That would be my yes, yes. The measure is backed financially by a guy named Brian Heywood. He's a hedge fund manager funding the effort through his political action committee, let's Go Washington, which has raised nearly $3.3 million. The opposing campaign no Hate in Washington has raised roughly 1.3 million. Heywood argues the state's 2007 policy allowing kids to join teams matching their gender identity comes at the expense of female athletes and their safety. No, it fucking doesn't.
So we need to your kindergarten girl to take her pants off for me.
Yeah. Yeah. And I quote, the sad and cynical truth is that people are funding these ballot initiatives because they want to drive Republican voter turnout for a midterm election. This is from Chris Urchel of Glad with one A so G L A D Law. He goes on to say, it's just like 2006 when Republicans poured money into ballot initiatives to oppose marriage equality. According to the Washington Interscholastic Activities association, There's only about 10 transgender athletes participating among more than 200,000 students in the state's middle and high school sports programs. 10.
That's just. That's terrifying to think about. It's just terrifying to think about.
Yeah, it's disgusting.
It's going to hurt the children. Yeah, but they don't care about the children. They care about driving people out to the polls. They care about making life horrible for the LGBTQ plus community. Yeah.
And attacking our trans community more than. More than any of the other letters.
More than anything else. All right, from cbs. We're shifting gears here. Top federal prosecutor in the nation's capital carted a box full of wine. I'm sorry, a box full of evidence to the White House on Monday in a bid to prove to President Trump that the damage to the reform deflecting pool was caused by shoddy construction and not by vandals. That's according to sources familiar with the matter. U.S. attorney for D.C. jeanine Pirro, a staunch ally of the president, made the case in a sometimes heated private meeting in the Oval Office Monday, hours after Trump had publicly rebuked her for dropping criminal charges against Olympic canoeist Davey Hearn. She was later photographed leaving the White House carting a large white box and other bags, which sources said contained all the evidence collected from the Interior Department that exculpated Hearn proved his innocence and several others from criminal vandalism. By the way, the DOJ today dropped charges against all the other people that they charged in the reporting.
Of course they did.
Piro's office has suffered a number of high profile setbacks involving cases related to Trump's enemies and topics of personal interest to him. Earlier this year, a grand jury uniformly refused to indict six Democratic lawmakers for posting a video urging military members to follow the law by not following unlawful orders. Historically, a grand jury refusing to return an indictment is very, very, very, very Very, very, very highly unusual, let alone having a grand jury unanimously refuse to do so, which happened in that case. Then the chief Judge for the U.S. district Court for D.C. quashed grand jury subpoenas issued by Pirro's office to investigate former Federal Reserve Chairman Jerome Powell and the Fed itself in connection with a costly renovation and statements he made to Congress about that work. In doing so, the judge said the subpoenas were merely, a pretext to pressure Powell to lower interest rates. They saw right through it. Pira later dropped the investigation, but not before several of her deputies first made an unannounced visit to the Fed's construction site and tried to gain access to the property before being turned away. And by the way, that quashing is what led to the very famous press conference where she says, I don't care about not guilty. I don't care about no true bill. I'll put all the crimes in. I'll do it all. Thank you. Remember that one?

My favorite. That led to me starting to impersonate her, which I never thought I would ever do in my whole entire life. but that was that press conference.
She makes it easy, that's for sure. All right, this story's from Democracy Docket, talking about the U.S. department of Justice. The DOJ is 0 for 20 in its lawsuit seeking to obtain state voter roll.
I'm not a sports person, Dana. Is 0 for 20. It's bad. It's bad.
Yeah, it's bad. After a federal judge dismissed its case against Colorado. Now, on Monday, U.S. district Judge Philip Brimmer found that the DOJ did not provide a sufficient reason for needing the state's roles or a valid purpose for obtaining them as required by law. He also found that the unredacted state voter rolls aren't records that the department's even entitled to under federal law. Those findings echo the conclusions of every other judge to have ruled on a DOJ's voter roll lawsuit. Bremer, who happened to be appointed by George W. Bush, as we know, a Republican, dismissed the case with prejudice, meaning it can't be filed again. And I quote, trump and his DOJ are attacking elections and democracy. This is from the Colorado Secretary of State. Gina Griswold happens to be a Democrat, the defendant in the lawsuit, by the way. That's what she said in a statement after the ruling, and went on to say, we will not let them win. Today's victory affirms that Trump's DOJ has no rights to Coloradans, sensitive Voter information. I will always defend our elections from unlawful federal interference. Griswold has been among the most outspoken election officials in denouncing the DOJ's voter roll crusade. Of, the 20 voter roll rulings to go against the DOJ, 12 have come from judges appointed by GOP presidents. 12 of them.
More than half. Wow.
Yeah. Eight of those 12 judges, those were appointed by Donald Trump himself.
Holy cannoli. So, like 40 something percent of.
Yeah.
Oh, wow.
I know. The DOJ has lost the only, appeals court ruling to have been issued on the voter rule lawsuits, which came from the Sixth Circuit in the DOJ's case against Michigan.
Fantastic. And just real quick, here's the 20. You ready? And they're not all blue states, by the way. Arizona, California, Colorado, Connecticut, Illinois, Kentucky, Maine, Maryland, Massachusetts, Michigan, New Hampshire, New Jersey, New Mexico, New York, Oregon, Pennsylvania, Rhode Island, Virginia, West Virginia, and Wisconsin.
Wow. Wow. Yeah.
And I think he only sued 23 states and the District of Columbia, so I think there's only four left.
When does that become precedent? I don't understand when it. They're not like, let's. Can we just refer to the other case at this point?
It has to go. There has to be a conflict between two circuit courts of appeal, and then that has to go to the Supreme Court. So.
Got it.
But in the meantime, it's all stopped. He can't go for it. They dismissed it. A lot of these are dismissed with prejudice, which is pretty strong. Y' All Vote was founded after the Calais decision to organize Southern content creators and put energy and money towards state legislative races in the south to elect progressive candidates to fight back against continued gerrymandering and voter suppression. Southern states are gaining in population, so ensuring fair representation down here is the only way to prevent long term Republican takeovers of Congress and the Electoral College vote. Speaking of candidates in the South, I also want to give a plug for Jamie Davis who's running for Senate in Louisiana against the Trump endorsed candidate Bill Cassidy's seat. Jamie is a third generation black farmer from rural northern Louisiana and he is generating a lot of grassroots support throughout the state. His social media presence is great, but he's getting no national attention. Based a story that you shared on your Monday show regarding Abigail Spanberger restoring voting rights for 66,000 people who had served their felony sentences. I thought your listeners should know that there is a state constitutional amendment on the Virginia ballot in November that would restore voting rights to felons automatically upon completion.
People were like, why isn't this automatic?
Yep. A completion of their sentence without requiring separate individual action by the governor. This is one of the three critical amendments on the ballot. The second would codify reproductive rights in the state constitution, and the third would codify marriage equality in the form of protecting same sex marriage in the state constitution. Several Virginia indivisible chapters are working to ensure that voters in Virginia know that these measures are on the ballot and how, important they are. And we would appreciate the shout out. Thanks to everything you do. And we will not just have a shout out. We have a link to this in the show. I want to share a little bit of the joy. On July 30, an endangered leatherback sea turtle nested on one of our northern beaches in the Outer Banks of North Carolina. The last time a leatherback nested on the northern outer Banks was 2009, when my high school senior was a baby. Attached is a picture I grabbed from our local news of the leatherback. Also included is a pic of some of our other wildlife here in the northern Outer Banks. A couple wild horses casually posing next to signs reminding everyone that there are rules to protect them. We haven't been able to travel lately, but living in a vacation hotspot, some of y' all can travel here with just these pictures. Look at this. Wild horse laws. And there they are. And they're on the beach. Just hanging out on the beach. I love it. And the turtle. I love it. Beautiful. Thank you for that.
Yes. Next up from Beverly Pronoun. She and her hello ladies. Rumor has it that pandas are a popular pod pet tariff. So how about a panda cat? Her name is Zara Pandemonium and her TNR rescue rescuer Yaz. And there's a link here. Not a link, but a social media thing. And it's at tipsandwhiskers. Tips and Whiskers initially called her Panda, hence the unusual spelling of her name. She was born in a car engine block in Los Angeles, a rescued the day she was born along with her feral mama. Her nickname includes you little devil and my little monster. And she's a force of nature, endless entertainment and love. She enjoys adventuring and while mom was still alive, visiting her in the care facility along with visiting everyone else and making the staff think she was a toy automation on a leash. She also entertains people in airports who double and triple take and then want to take her picture. Favorite activities include sprinting around the house, getting as close to my face as possible for snuggle time and boosting me up when major depression is dragging me down. I've included two collages. One shows her playing inside the ring that's supposed to be a toy with a ball that can be slapped around inside. But she quickly figured out how to remove the ball, and it is somewhere in Casa Chaos. The second collage shows one of our favorite activities, which is pulling a cuddle clone forward out of the tall bookcase and then throwing it down at me. Keep up the good work. This summer I've been listening to the podcast while walking the Ice Age Trail in Wisconsin. It follows the border of the last glacier to enter the state. It is managed by the National Parks and maintained by many volunteers of the Ice Age trail alliance. The 1200 mile trail is one of the best things Wisconsin has to offer. After a protest rally in April of this year, some of the members visited Pratt's Pets, located next to the protest site, where they documented animals kept in alarming conditions. Along with the group's leader, Megan, protests began against Pratt's Pets, resulting in the store's Mesa location being shut down.
