So it was record breaking nights and we're just still in this fight. We're in this fight. There was a lot of joy and community in both of those rooms. So please know, as hard as things are, everybody, there are people out there still doing the work and trying to do as much as we can before the midterms to get everyone out to vote so we can elect pro equality candidates.

Oh, yeah, so he needs to be impeached. This is another reason we have to capture Congress. This is from the Post. The Pentagon's public tally of troops wounded during the Iran was quietly increased by 37 this weekend without explanation from the Defense Department. The increase includes 29 sailors and eight Marines, according to a review of the Pentagon's public database. And as of Wednesday, the total number of troops wounded during the Iran war is now 861.
Goodness. All right, thank you. And the Supreme Court on Friday refused yet again to back Missouri Republicans preferred congressional map. This is marking.
Yeah.
The high court's third action this month against the states GOP's bid to further increase its partisan control in the midterm election. So a win. We'll take it.
Yeah. And I'll be discussing that with Steve Vatic, self, proclaimed SCOTUS nerd professor of law. And we're going to talk about that along with other recent SCOTUS rulings on tomorrow's episode of the Daily Beans. And also, ABC is reporting that a federal judge on Friday found the Trump administration in contempt of court for deporting an asylum seeker to El Salvador in violation of three. Good Lord.
Court orders.
U.S. district Judge Stephanie Gallagher, a Trump appointee, ordered the government to return the man identified in court documents as Ela to the United States and to refrain from executing any removal orders against him until his asylum case is fully processed. According to the court documents, ELA was wrongfully deported twice. Friday's court order requires both parties to provide an update on Ela's return to the United States by October 2nd.
Okay. And from the Times, a new ad flashes images of the schmuck in the White House set to a striking soundtrack track, a song titled Love Me. Even more striking, maybe the disclaimer, and I quote, paid for by US Government. That would be our tax dollars. The commercial debuted this week on right wing news outlets. According to media tracking service Ad Impact Now, Donald has urged Republicans to vote in the November midterms as if he were on the ballot. I would be fine with that, too. Trying to draw voters who typically turn out only for presidential elections to the polls, he asked Republicans at a midterm convention in Dallas this month to join him in a loyalty oath to himself. And I think it's fucking hysterical because he's like, when the polls are down for other Republicans, he's like, well, I'm, not on the ballot. And now he's like, vote like, I'm on the ballot.
So, heads I win, tails you lose.

from Bloomberg Law, they're reporting that FBI leadership Kash Patel removed two counterterrorism experts due to dissatisfaction with their investigation of allegedly threatening phone calls made to senior White House aide Stephen Miller's wife. That's according to three people familiar. The orders from the bureau's D.C. chief, Darren Cox, stemmed from, I guess, frustration shared by the Miller family that the field office was moving slowly in probing allegedly harassing phone messages. Andy, McCabe and I are going to discuss this more in depth on the next episode of Unjustified. I know Andy has worked with one of these counterterrorism experts in his career and knows him quite well.
Fantastic. And we've got one from cbs. Iran on Sunday insisted on its conditions for reopening the Strait of Hermouse, despite Donald's rejection of the proposal. Iran's plan called for a cessation of all hostilities in the Middle east, including in Lebanon, according to Foreign Minister Abbas Aragachi, and fulfilling conditions in the ceasefire deal that fell apart months ago.
Yeah, so they're not backing down on this. They're like, you've got to stop bombing Lebanon. No go. Hormuz remains closed. Next up from pbs. Uk Police said Sunday that five men arrested in the middle of the night near an, air base used by the United States during its war in Iran are being held on suspicion of preparing a terrorist act that appeared to involve three trucks. The five men were initially arrested on suspicion of committing offenses under the Explosives act in the Welford area, which backs onto RAF Fairford. That's the Host's headquarters of the U.S. air Force's 501st Combat Support Wing and the 420th Air Base Squadron. So, close call and probably could have been thwarted far more easily if our five eyes partners were actually working with us and Kash Patel and this particular, administration weren't such assholes.
Yeah, that sums it up. I like when we say that. All right. And from the Post, the White House has blocked CNN from traveling with Donald's Air Force One for a Saturday trip to Knoxville, Tennessee. That's according to two people familiar with the decision who spoke on the cond of anonymity, of course, because they're not allowed to talk about this. The decision puts the state of the rotational pool, the TV pool, which briefly resumed Friday, back in jeopardy.
Yeah, we'll see what happens there. All right, let's see if we can get through today's news before Christmas. It's time for the Hot Notes. Hot Notes. All right, first up, from CBS and content warning. This story is about sexual assault and rape. And if you or someone you know has experienced rape or sexual assault, free confidential24.7 support is a available through the National Sexual Assault hotline, operated by Rain at 800, 656 Hope Cornell University and 7 Kai PI fraternity. I think it's Kai. Five fraternity members are, ah, facing a lawsuit over rape allegations. A former student alleges that in October of 2024, okay, two years ago, she was drugged and gang raped at the frat house. Her attorney claims that after an investigation, only two of the accused were expelled and no one was arrested. Now the former student is suing the school and the fraternity members, claiming they failed to protect her and prevent the alleged assault. According to the lawsuit, the student, identified only as Jane Doe, was 20 years old and attending her dream school in Ithaca at the time. She says she went to visit a friend at Cornell's Chi Phi frat house while she was intoxicated and alleges that two frat brothers pressured her into snorting what they said was ketamine before they sexually assaulted her. Then a man allegedly sent a message to the frat's Snapchat group suggesting a woman was available for sex. I believe the text said free pussy. According to the complaint. Doe says more men showed up and that she was raped for hours. The complaint says that Doe filed a report with the university's police department about three weeks later. Cornell conducted an internal investigation, kept it quiet, and involved at least 12 hearings. Doe's attorney, Thomas Giuffra, claim that of the seven fraternity members. Two were expelled. The others received lesser sanctions, including suspensions and workshops. And some all they had to do was write an essay or an apology note, quote, none of these guys was arrested. Not one that I can tell you for a fact. That's what the lawyer said. And Doe dropped out of school after the assault. The Cornell Daily sun published an editorial yesterday entitled Cornell Won't, we will, where they called the school out for covering up the entire incident. It says, Matthew Ingalls, Jonathan Newell, Winston Lee, Gilio Lopez, Diego Sarabia, Scott Norris, Scott Kretshemar. Those are the names of the seven men named as defendants in a civil complaint filed Sept. 14 alleging they drugged and gang raped a Cornell student identified as Jane Doe in the Kai phi House on October 2024. So they continue. We ask the questions the university has left unanswered. If Cornell follows the law, then we should have access to a public deposition issued from the school. The Title IX investigation opened in January of 2025. And how it concluded. Why were these men allowed to pursue their education in a secure and nourishing environment and she was not? Why was she not informed of the outcome of her own Title IX investigation? Who benefited from the 23 months of elapsed time when the public knew nothing? this is a devastating story.
Yeah. This story took over my Instagram feed, and it's horrifying. I hope these boys, because they're definitely not acting like men, never have a day of peace in their lives.
And what about the people, Everyone. Everyone in that Snapchat?
No one fucking stopped it. Not one of those boys was raised in a manner or they weren't paying attention when they were raised in that manner to say, this doesn't feel right. Don't do this. Please stop this. Absolutely not. They showed up. And one of them who started this whole thing is what pisses me off, was her friend. She trusted him. He was invited into this house. And now what they're doing is they banned the fraternity from the school. Are you kidding me? That is the. That's what we're doing. I hope she wins this lawsuit. I hope there are. I, hope there are consequences because we've talked about this over and over. This is why people like Kavanaugh end up on the supreme fucking Court. Because nothing happens to these boys where they're at Cornell University and they gang rape a woman for seven hours.
Yeah, we have to ruin their lives now so they don't ruin ours in positions of power later. they're already destroying lives at the ages of 18, 19, 20.
Just disgusting. Just disgust. I'm sorry that we kicked off the hot notes with that, but it's such an important story, it was buried. This happened in 2024, as Allison said. And now this is the civil lawsuit. So I'm really hoping that justice is served in this case. All right, this next story is from Politico. Governor Mikey Sherrill of New Jersey is calling out her handpicked lieutenant governor to resign after a months long, closely guarded internal investigation found he made a comment that, and I quote, constituted sexual harassment and engaged in ethics violations. Good for her for calling him out to resign. The first, reported on September 4, but commissioned by Governor Mikey Sherrill more than three months earlier, focused on Lieutenant Governor Dale Caldwell's conduct in office. The report claims that Caldwell told a female staffer that, and I quote, you young women are looking for your young sperm after he expressed romantic interest in her friend. Caldwell is also accused of twice attempting to promote a romantic partner in a state job while not disclosing the relationship and taking personal guests to paid events without paying admission. Cheryl called on him to resign from office by this Friday, this past Friday, although she has no authority to actually unilaterally force him out. But he did resign on Friday, a day after investigators concluded that he had used sexually charged language and had exploited his position to try to secure a promotion for a girlfriend and dates for himself. And not all men, but Jesus Christ, a whole lot of fucking men.
Well, these are the motherfuckers who end up in positions of power like lieutenant governor of this state that were allowed to graduate from their universities after taking part in what happened in Cornell. You know what I'm saying?
Yeah, I do know what you're saying.
Next up from democracy docket. In a dangerous decision for voters, the Supreme Court authorized the Trump administration to overhaul a federal immigration database into a vast, centralized and deeply flawed database of Americans personal information to initiate registration purges. The decision lets the Trump administration move forward with a key provision of Trump's 2025 anti voting executive order, much of which courts have permanently blocked. At least five of the court's Republican appointed justices lifted a lower court order that found DHS modification and use of the SAVE system. The systematic alien verification for entitlement system trampled on the privacy rights of American citizens in a manner that threatens the sacred right to vote. Now, the Supreme Court said. No, it doesn't. In her dissent, Justice Jackson said of the inclusion of Social Security numbers in the modified SAVE system explicitly violates confidentiality requirements in the law that created the Social Security Administration. She said nothing authorizes the modified SAVE system or overrides the provisions of the Social Security act and the Privacy act that respondents say the government has violated. And the government puts forward no non forfeited arguments that the modifications to SAVE in fact complied with the Social Security Act's confidentiality provision. And in a similar story from NBC, Texas officials sent tens of thousands of delayed voter registration applications to county election officials this week after discovering an error, which I put in quotes, sparking a scramble to process them just weeks from the midterms. The Texas Secretary of State's office told election officials last week that a problem with the Department of Public Safety system had been uncovered. Certain incomplete voter registration applications that were missing some information were not sent on to election officials, potentially leaving Texans unregistered or with out of date voter files. The nonprofit news outlet Vote Beat was the first to report the problem. I would bet money, Dana, that they just sat on these.
Oh, yeah.
And didn't send them until a couple weeks before the election.
Yeah, I would bet money, too.
State, officials started transmitting the records on Tuesday. It's unclear how many voters have been affected, but large counties have reported tens of thousands of registration applications and updates that election officials must process in the less than a month before early voting begins October 19th. And more applications are sure to pour in ahead of the Oct. 5 deadline to register to vote in Texas. So, I, Mean, when you think of all the shenanigans that they're trying to pull, especially in places like Texas. Yeah. I can't imagine this was an accident. I can't either hang on to these voter registration applications and then maybe in hopes that because their stuff isn't in the SAVE system or the USPS portal or whatever, that they would be purged, you know, before or, you know, kicked if they're reg. If, like, if these are address changes. Yeah. You know, it's just.
They're gonna do everything they can. They're gonna do everything they can. You know, they're gonna lose their ass. They know it. All right. This is from the Times. OpenAI's artificial intelligence, because that's what it is, went rogue and meddled with. I know. I can't. I can't. Don't even start with me. Meddled with the websites for the Education Department, the Commerce Department, and the securities and Exchange Commission this summer without the AI Labs knowledge. According to security researchers and a person familiar with the episodes. That sounds safe. The incidents involving the Commerce department and the SEC were confirmed by OpenAI. I'm sort of laughing that OpenAI has confirmed that AI went rogue on three of these fucking departments, which said it was continuing to investigate the situation with the Department of Education. The San Francisco company said it had notified the government agencies in recent weeks that its AI agents, which are bots that can act autonomously, which is terrifying, interacted with their sites in unusual ways with the education department opens. AI's technology tried to hack the website to gather data from the department's civil rights office, but it failed. This is what, researchers from the AI research firm Transloose said. The AI also pulled data from the Census Bureau website, which is housed at the Commerce Department, using login credentials it found online. Separately, OpenAI's agent shared public data from the SEC website on an online forum. None of these incidents were breaches, OpenAI said, but were examples of its technology behaving in unexpected and concerning ways, you think? The company recently discovered the occurrences while conducting a review of hacks carried out by its technology, including an attack on an Australian government website in June and an AI startup hugging face in July. The cool, cool, cool, cool, cool, cool.

That's what's scary. But a lot of people in Texas are finding out that they thought they were registered, and they're not. So, make a plan. Talk to your friends, your family. We've got to make this the biggest blue tsunami ever. I mean, they talk about, this is the most important election of our lives, but this one really is because we're this close to losing democracy as we know it. And, we have to make our voices heard. Absolutely.

I mean, I wish I lived in Texas. My half family that live in Texas in Austin that they call Austin the blueberry and the bowl of, tomato soup that is Texas. They have some spectacularly bad candidates. By the way, Ken Patson is almost a parody of the corrupt politician. And, I don't know. I mean, I'm not, but I'm hopeful we can obtain, turn, Texas blue, despite Ted Cruz, Louie Gomert.

Well, just today, John Cornyn said he's not going to help and fundraise for Ken Paxton.
Yes. I mean, the thing is, if, they run John Cornyn, Talrico would have had a much, much bigger challenge. I mean, the fact that the president endorsed Ken Paxton. I said yes. He's doing everything impossible, you think, to lose the election. Well, people really worried about filling their gas tank and where they're going to pay their groceries or the kids school supplies. He's talking about ballrooms and renaming bodies of water. It's just the, the Triumphal Arch. I mean, it's almost comical. But he, I, he's losing his base, which I think is fantastic. There's a real break even in the MAGA crowd because all the things that he said he was going to do, he hasn't done. And, they. They're feeling it.

This is a shout out to my good friend, activist artist Frida Weissman. Frida is out every week on the streets of Seattle, making her voice heard. She's also an active supporter of the arts community, seeing art around at studios, galleries and museums throughout the region. She calls me a hermit because I usually only get out to my own local openings, which are rare. We met at one where she and I were in a group show at the Columbia City Gallery a few years ago. We are now avid wordle pals every morning and get out for coffee every so often. We can laugh about the fun and the hard things, which is rare and special. My photos are me wearing a scarf Frida made out of clothing I donated for her creations and my portrait of her, Free Babe Freedabi. Freedabi Frida, Babe, Free Babe, you and me, which captures her impishness but not her loveliness. The portraits in the studio of artist Stephanie Ames, whose work Frida was imitating in the pose.

Every fall in Montreal, the Botanical garden holds an event called Gardens of Light in which their Chinese, Japanese and indigenous gardens light up after nightfall. Lanterns and displays from China are the big attraction. Here's a photo from the Chinese garden. Chicken lanterns. Oh, hell yeah. Plus a nice shot of the 1976 Olympic Stadium, which is admittedly kind of ugly and a sinkhole for public money, but which holds a soft spot in our hearts. Happy 50th anniversary to the big owl. I'm a longtime listener from the kitchen table days, but it's my first time writing in to share some highlights from Chicago. I would like to start by bragging about my younger sister. She worked her ass off to get back to school at 36 and is amongst the 4% of applicants to be accepted into Duke Medical School. PA program. Fuck yeah.
Yeah.
It's never easy making the return to school. And for a moment there, the asshole in chief made it even more daunting when the PA program was stripped from the list of professional degrees. But thankfully it's been reinstated. What the fuck? How is a physician's assistant stripped these fucking people?
I don't know, man, because every time I, you know, pick a, primary care provider, I always pick an NP or a PA.
Always. Yeah.
100% of the time he probably thinks
it's just an assistant. That's why they were like, we don't need assistance to physicians, fucker. As for myself, in May, I recognized that my anxiety was at an all time high and I couldn't regulate my nervous system. I lost my soul cat of 17 years two years prior. And it occurred to me that it was a big part in my ability to do that. So I went to the shelter and I adopted two 15 week old kitten sisters. Their names are Stevie Nicks and Joan Jett. Stevie and jj. Affectionately. They are two of the most amazing creatures. If there is anyone out there on the fence or, whether it's the right time. Time. It's the right time. They have helped and healed me tremendously. I've Attached, some pictures. Stevie is the white gray girl with a raspy meow, and JJ is the silver and black. Thanks for always being familiar voices in my day and for all the hard work that you do.

I had such a great time at Dana Chicago show and was thrilled to meet some fellow Leguminati along the way. Photo evidence attached. It was also my birthday. Rob, I'm sorry. I didn't know. And honestly, laughing with Dana and a room full of like minded folks was a pretty perfect way to celebrate. Thank you for all you do.
