In the Cornell 7, the Department of Homeland Security inked a multimillion dollar deal with one of Kristi Noem's biggest donors right before she left the agency. ICE agents are asking detainees if they've ever illegally voted in Trump's latest desperate attempt to find voter fraud. Yes, same. And as I'm sure you've all heard by now, Donald Trump called for Iran to, quote, take out. Let them take out Los Angeles. Let them take San Diego.

Oh, yes, I did.

And I. Somebody sent that to me yesterday at like, five in the afternoon, and I immediately posted. I was like, I'm not going to post the video. But Donald Trump just invited a to destroy two American cities and people were like, you're crazy. That's not what he meant. That can't be it. That can't be right.

It's what he said. And we're going to talk about that over on Beans Talk today. Beans Talk is our companion show to this podcast. It's a totally different show and it's a video show and you can watch it on our YouTube channel at MSW Media Media. Just search for Beans Talk or search for MSW Media Media. You can get all of our stuff over on YouTube as well. All right, we have a lot to get to today. Let's hit the Hot notes. Hot notes. First up from the Times. Cornell University has named Sally Yates, that's the former acting US Attorney General, on Tuesday to lead an independent internal review of the former student's rape claim amid growing outrage about how it was handled. You remember Sally Yates. A lot of us wanted her to be the attorney General.

Yeah, I may have crushed it on Sally Yates when she, testified in front of Congress.

She was fired, eventually by Donald Trump. And it was, you know, basically because she refused to enact the Muslim ban. Do you remember Sally Yates? And she was in our Sexy Justice Calendar. Our mulcher wrote Sexy Justice Calendar, which is just, which is just like 1950s pinup girls with people's like, heads badly photoshopped, pasted on top of them. Andy McCabe was Mr. February, for example. Sally Yates. Sally Yates was Ms. October, but one of my favorite people from back in those times. Now Yates, who's 62, is also going to examine the school's policies related to sexual assault allegations, including how they're investigated and what support is given to students. Good. Ann Smalling, the head of the committee that hired Yates, told the New York Times that the university was obligated to the woman who had filed the rape complaint. We owe it to her in our community to take a hard look at what happened so that we can determine what we can do better around both prevention and response, she said. Ms. Yates and the New York white collar law firm King and Spalding, where she's a partner, will, quote, have full independence in conducting the review. That's what Cornell said in a statement on Tuesday. Students and politicians have demanded answers from Cornell after a former student sued the university, Seven Men, a fraternity and her sorority in September for claiming she was sexually assaulted in October of 2024 at a fraternity party. She claimed the university allowed the culture to flourish that led to the assault and then did not conduct a thorough and proper investigation after she alerted campus police. Her claims have set off a wave of shock and anger across the country and renewed national conversations over sexual assault on campuses. Three weeks after the incident in 2024, the woman, identified as Jane Doe in court papers filed a report with campus police, which was then passed to the Tompkins County District attorney. Kind of. Who declined to file charges. All the men have denied wrongdoing. None of the men have been charged with a crime. The fraternity Chi Phi has been banned from campus. All fraternities should be banned from campus.

Yeah, no kidding.

The university though, conducted its own months long investigation which included more than a thousand pages of transcripts and text messages, hours of interviews with dozens of people, and the woman's statement to police, which she signed. A three member panel at the school met over Zoom over 12 days in May of 2020 and expelled two men, barred one who had graduated from campus, suspended two and gave lighter punishments to the rest, according to the documents. The panel did not conclude that Jane Doe was sexually assaulted by all the men she had accused, according to discipline summaries reviewed by the Times. The District Attorney, Van Houten, has said that the Cornell University Police Department only forwarded a six page summary to him, but that's because they also ah, told him about additional interviews, remember, and he said we're not interested. Yep. According to the records, the police there see did offer Van Houten more evidence, but he declined to do so. Hochul rebuked Van Houten on Thursday and appointed the state's Attorney General. As we know, Tish James to review the evidence and determine whether criminal charges should be filed. Ms. Yates is a high profile choice for a role that will inevitably be deeply scrutinized. She previously led the U.S. soccer Federation's investigation into allegations of abuse and misconduct in the women's professional soccer and currently leads King at Spalding's crisis management practice. She spent nearly four decades with DOJ. She became assistant U.S. attorney for the Northern District of Georgia, which is her home state, in 1989, rose through the ranks to become the first woman to lead that office in 2010. She became deputy U.S. attorney general in 2015 under Obama, and in that role, she wrote a policy memo known as the Yates Memo, redefining how the country prosecutes white collar criminals. In 2017, days after accepting the role of acting Attorney General under Trump, she was fired for refusing to enforce the President's immigration ban. Look, See, they always get around to eventually what I say what I break in with in the middle of stories.

So, yeah, no, she. She's incredible. I love all of this. I feel like justice is moving in the right direction. This is from Ms. Now. Lawyers for former Olympian David Hearn, whom the Department of Justice wrongly accused this summer of damaging the Lincoln Memorial Reflecting Pool, urged internal investigators at the justice and Interior departments to probe what led to what they are calling an abuse of government power. Huh? Uh-huh. And I can tell you what led to it. In a letter sent Tuesday morning, Hearn's legal team said he suffered a nightmare after he was arrested on June 19 and indicted two weeks later for allegedly vandalizing the pool's liner. Despite both the justice and Interior departments having information that showed the damage was due to flawed installation of new coding that was ordered by Don Tunneled, not the damage that Hearn supposedly inflicted because there was none. The letter calls on dawn are Berthum, the DOJ's inspector general, and Carol Bursmouth Burmauth. Excuse me, everybody. I would like for you to see this last name, Birzy Meowkiewicz. We're going with that. Birzy Meowkiewicz, the Interior Department's inspector general to fulfill their mission to ensure ethical and competent government conduct. And I quote, From June 19 to present, Gross incompetence, negligence and misconduct have been committed by personnel in both agencies. The lawyer's letter said. Went on to say a critical purpose of the requested investigations is to collect the facts to hold accountable the individuals and groups who failed Mr. Hearn, the criminal justice system and public. In an email to Ms. Now, a spokesperson for the Department of Interior wrote, and I quote, david Hearn admitted to officers that he was tampering with the reflecting pool and included a screenshot of a court document that cited testimony by an unnamed Park Service employee who claimed to witness Hearn violently ripping the pool's lining.

Whatever.

And I quote, the Office of the Inspector General operates independently and makes its own decisions about what to review. That's what a spokesperson for the DOJ told MSNow. The offices of two inspectors general did not immediately return Mississippi Now's request for comment.

Yeah, I mean, that's nice. you know that you. To the lawyers there of Davey Hearn, that you think that these inspectors general are going to do anything. Yeah, but resubmit your letter in 2029 for real. Next up from NBC. The Trump administration pushed the FBI to investigate Los Angeles protesters in violation of their constitutional rights and the bureau's policies. By the way, that's according to a former FBI supervisor who has written a new whistleblower complaint. Her name is Jill Fields, a former supervisory intelligence analyst in the FBI's Los Angeles field office. She made a formal whistleblower complaint to the Senate Judiciary Committee leaders over the federal response to anti ICE protest activity around federal buildings as well as in a residential area. Early last year, Fields asked Congress and the Justice Department watchdog to investigate the allegations. That's what her attorney said in the letter. She said they violated the First Amendment right to free speech and peaceable assemblage. Now, Fields says Emil Bovet, then acting deputy Attorney General, told the head of the field office to open an investigation into activities outside the federal building, even though she says the activities were protected free speech. Separately, she says the White House gave a directive to FBI Director Kash Patel to investigate a group of protesters using megaphones during immigration enforcement operations after FBI agents had conducted a check into the conduct and declined to open an investigation. Now, President Donald Trump had viewed a video of people using megaphones to alert residents about immigration activities, advise them of their legal rights and encourage them not to open their doors. Right. Unless immigration enforcement agents had signed judicial warrants. And a person whose name is redacted in the complaint told Fields, that's the whistleblower, that an investigation would be opened because, quote, the president wants this investigation. Now, Andy and I are going to cover this in more detail on this weekend's Unjustified podcast. Having worked at the FBI for over two decades, I know he's going to be able to have a lot of insight into this particular incident.

I would imagine so. This next one's from the Times. In the last hours of Kristi Noem's tenure as the Homeland Security Secretary, her agency delivered a windfall to one of her political donors by buying five airplanes from the man's firm at a substantial markup. The Department of Homeland Security agreed to pay the donors firm $108 million for a Boeing 737 airliner that had been converted into a massive private jet, complete with a stand up bar, two bedrooms, marble showers, and a table covered in manta and manta ray skin. What the fuck off.

Ew.

The firm, which is called De Delous Aviation Corporation, had bought the same plane a few months earlier from a seller who had asked for less than 90 million, according to documents reviewed by the New York Times. At the same time, I know all these. At the same time, the agency agreed to buy two smaller Gulfstream luxury jets at prices that also seem to yield a hefty profit for the seller, Delos spent about 83 million to buy the pair, but resold them to the agency for $106 million.

They're just stealing our money.

Yep, they sure are. The agency also paid the company 45 million a piece for a pair of 17 year old Boeing 737 Passeng planes. That's what the document shows. The Times spoke to six aviation experts who said that those prices were millions of dollars higher than the typical market value for jets of that age. Is anyone else having little 911 freakouts in their chest? Is it just fucking me like we're selling these jumbo jets to. I don't know. I don't know. Who wants to protect or hurt this country. I.

You?

I don't. I don't like any of this. I know I have my little tinfoil hat on, but I just don't like it.

Well, and whatever it is they're buying and selling, they're just. They're paying millions of dollars over price for junk.

Yeah. Yeah. By the way, through the newly acquired documents, the Times is now revealing fresh details about five of those planes. The three luxury jets and the two $45 million passenger planes. They were the most expensive planes the agency bought from De Delouse and were purchased in a bunch on Ms. Gnomes last morning in office.

Right. Like here, here, let me buy. Let me use the government to buy a bunch of your old planes that for $20 million more than they're worth. Yeah. On my last.

I don't like any of it. I just don't like any of it.

Next up from the Associated Press, Krista Pike. Oh my God. The Tennessee inmate who survived Tennessee's attempt to execute her twice is awake and speaking as she receives treatment at a hospital. According to her attorneys, quote, against all odds. Christa pike is conscious, speaking and continues to receive critical medical care. Despite the severe damage she endured to her ar, she is still handcuffed and shackled to the bed. Her recovery is medically unprecedented. Her prognosis remains unclear, but at minimum we expect a long recovery. Her attorney said they're grateful for the first responders and the medical team at the hospital who treated Krista like a human being and have provided exceptional care to her.

Absolutely. I really appreciate that. I'm glad they included that in the story. This is from the Post. Federal immigration officers are now asking immigrants they arrest if they have ever voted illegally and whether they did so by mail or in person as part of a pre election push to root out alleged voter fraud. Jesus Christ. U.S. immigration and Customs Enforcement first added the voter information question to its booking intake system in late August. And this is from a former official. That's what they said. On the condition of anonymity to discuss internal operations. An internal ICE email reviewed by the Washington Post said that beginning October 1, immigrants who admit to voting illegally would be asked if they did so by mail or in person. And are you going to ask who they voted for or just. I'm just curious. I'm just curious. All of this is such.

Oh my God. And I can't believe this is how they're trying to find voter fraud. They wanted to. They could let Tina Peters out of prison, who committed actual voter fraud. Okay. Anyway, well, next up, President Trump said Monday he will no longer use taxpayer funds to pay for his multi million dollar pro Trump ad blitz ahead of midterm elections, saying his super PAC will now pay for them. But he appears to have no plans to reimburse the federal government for the funds already used on the ads. Quote, the President's social media post was not referring to reimbursement. That's what the official told ABC News from the White House. While Trump dismissed criticism of the ads as a rather standard thing to do, he posted Monday that he decided to pay for them on his own dime. Which, by the way, admitting that the super PAC is your own dime when you're not supposed to politically have any contact with any super pac and between a candidate and a super PAC is pretty fascinating.

I mean, but no one's calling him out on this shit.

He's not a candidate technically. Right, but, but they're his. But they're packs for him.

I actually do not. I don't know. I don't know. I don't know.

Bizarre.

I don't know everyone, but I do know. This next one is from the Cook Political Report. Four weeks out from election Day, the Senate map is shifting further in Democrats favor. Woo hoo. And with it their odds of winning back the majority. While Republicans continue to have a financial edge in almost every competitive state, the president Donald Trump is a drag across the board, even in deep red states due to rising fuel prices and the persistent high cost of living. At this point, the question isn't whether Democrats will gain seats, but how many. As much. We are revising our estimate. This is from the people doing this as much. We're revising our estimate of the potential pickups to two to six seats for Democrats, squarely within the range of the four seats they need to net for a majority. And we are moving, three Senate Ratings all in Democrats direction. Kansas from lean Republican to a toss up. New Hampshire from toss up to lean Democrat. And North Carolina from lean Democrat to likely Democrat. Come on, Roy Cooper.

Kansas is a toss up in the Senate race, which they haven't elected a Democratic senator since 1932.

Yeah, they keep, they've elected governors though, in Kansas. Democratic governors. So there's not that unlikely that they would be like, all right, let's get a senator in there too.

Yeah, well, it's kind of different, right? Like, you know, I think maybe. I think that's why you're seeing David Jolly in Florida pull ahead of Angie Nixon and you're like, why? She's awesome, right? It's, it's because, I don't know, it's easier to get a governorship than a Senate seat for some reason. Yeah, I guess so if you're in a red state. If you're a Republican, I don't know. I guess it's like, we like the, the Democrat, like what they do here in the state, but we don't want them in the Congress. I don't know. I don't know what goes through their heads.

It would be really interesting to see if Andy Beshear ever ran for Senate. I think he'd probably go for a presidential run first. But he's so beloved in that state and keeps getting reelected even though he's a Democrat who supports the trans community in Kentucky. I mean, in Kentucky, like, I wonder if they would elect him as a senator. It's fascinating to me. Yeah.

I'm not sure. I mean, that's something. The thing I really love, though, about Bashir is that he proves as a Democratic governor of Kentucky, and as a candidate that you don't have to throw trans kids under the bus.

Exactly.

He's ahead by. How many points is he pulling ahead?

I don't know.

I mean, or when he won. He won really handily. Right?

Yeah.

But, well, he's not running for anything. He's just the Governor of Kentucky, right?

Yeah, he's just the governor of Kentucky. But I do think Andy Brashear may put his hat in the ring for 20, 28.

I would.

Why not?

I would if I were him for sure. And we could then, like, we look at, see what Roy Cooper's like, what he's doing. Right.

100%.

So anyway. All right, everybody, we have a lot of good news we have to get to, but we have to take a quick break. Stick around. We'll be right back after these messages.

We'll be right.

All right, thanks so much. This is from Sarah in Maryland. Pronounce she and her hello Beans Queens. My good news is that today I attended training to be an election judge in my county for the upcoming midterms. I've been protesting and boycotting, but felt strongly that I wanted to help out during the election, something I've never done before. The training was very informative. We got hands on experience with the voting machines. The actual voting day will be a long one for all poll workers, starting at 5:45am and lasting until after the last voter in line has voted. Once the polls close sometime after 8pm I'm excited to help fellow citizens exercise their constitutional right to vote. Especially as a naturalized citizen myself. I'm also like to make a suggestion to the wonderful beans community. Due to cuts in SNAP benefits and inflation, hunger is increasing in this country. Last spring I went online to find our local food bank and set up an automatic monthly donation. It comes directly out of my bank account. I don't need to remember each month to donate. It's so easy. So for anyone who can afford to and who wants to make an impact for people in their community, this is an easy way to do so. For Pod Pet tax, I give you both a baby and a baby goat. Oh my goodness. This is my grand can barely handle this. This is my granddaughter who she was about a year old meeting a baby goat at our country farm fair. They gave each other a kiss. The second pick is of her and me during her high school graduation this past May, she and her family moved to Arizona, and I flew out to see her graduate. She's now getting all A's in her local community college. She's smart, smart, talented, and kind. I am so proud of her. Oh, and she's beautiful, too.

Oh, my gosh. Oh, look at that. Amazing pictures.

Yeah, this is awesome.

That's a double whammy. A baby goat and a baby.

I know, right? Come on, everyone, try and top that.

I, want to know what community college is she going to? Is she an artichoke? Is she going to. Is she going to the Scottsdale Community College where. Where in the 1960s, they had a vote and decided that they would be the artichokes and that their colors would be hot pink and bright green?

Stop it.

Scottsdale Community College, baby. all right, next up, Lisa Pronoun. She, her, hers, dearest beans, queens and all who care for them. I'm m so excited to head downtown D.C. tuesday for training for the October Surprise.

Yay.

Thanks to hearing about it from your guest a while back, Cliff Cash. I must be a part of whatever it will take to turn our country around. Thank you both. And, Cliff, for the inspiration. I'm including a photo of my favorite sign from the hands off Kennedy center protest. Lol. It's just less butthurt, more Beethoven.

Nice. Oh, my God.

and then, of course, we have the, ad for the October surprise, which is happening right now. We're in the middle of it October 6th through 8th, with Cliff Cash, over there. Anyway.

Ah, awesome. All right. From Amanda Grace. Lovely name in Alabama. Pronoun. She and her. Hey, ladies, Amanda from Alabama Here, Alabama, Amanda. A damn mouthful. Either way, I'm writing in with some good news from here in northeast, Alabama. For the first time since I've lived here, we actually have Democrats to vote for on most of the ballot. Female Democratic, progressive of candidates. Do you hear what this person is saying? That means that a lot of these people had gone uncontested in a lot of these races. And finally, there are Democrats running against them because they think they can actually take these people out. And this makes me happy. In past elections, for so long, for such a long time, it's been so disheartening because so often there weren't even any Dems to vote for. Amanda Pushchick is a nurse running for Congress to unseat useless Trump puppet Robert Adderholt. Katie Kramer is running for Alabama State Senate. She's our neighbor and friend and the VP of Operations at the metal manufacturing plant she and her husband own in Valley Head, Alabama. She's running against Steve Livingston, a Republican I know nothing about. Wayne Rogers is running for Secretary of State. Doug Jones, who was elected senator over that creep Roy Moore back when being a known pedophile would actually get some Republican voters to refuse to vote for you is running for Governor. Doug Johnson be a great governor Governor. And we really need him to win over actual idiot Tommy Tuberville who isn't even eligible to run for Governor because he does not live in Alabama and hasn't for a very long time. Philip Ensler, a former school teacher, is running for Lieutenant Governor. Jeff Laughlin is our Democratic candidate for State Attorney General. Ashley Dunham is running for Associate justice of the State Supreme Court. Place 8 Shatika Armstrong is the Democratic candidate for State Board of education. Place 8 Ron Sparks, who was once Alabama Secretary of Agriculture is running to take that office again. Rosalind Houston. or Houston could be either one for State Treasurer running against I shit you not, Young boozer. That's his street name. Or what Violet Edwards were Violet Edwards for State Auditor. James Gordon for Public Service Commission place one and Sheila McNeil for Public Service Commission place two. We've got so many non Republicans to vote for this year. Let's get excited Alabama and get everyone out to the polls. We can get rid of it. Least a few of these people and this incompetence hateful maga puppets. If you're in Alabama this is a great tool. If you're like I'm overwhelmed and I don't know who to vote for, it seems that this person has laid it out for you. Yeah, I'm not going to list websites for everyone. I just mention it because we will be here all day. But I would really love if folks, especially in northeast Alabama would Visit Amanda for Alabama.com Amanda for Alabama.com and Kramer with the K for Alabama.com we're gonna have links to both of these people in the show. Notes for my pot pet tariff. I'm including a couple of photos of a new black kitten we found crying underneath my shop about a week and a half ago. He was given a clean bill of health. Weighed about 1.96 pounds and we have named him Edgar. The first photo is Edgar who is first emerged from under the building. The second photo was Edgar with a middle cat Roswell who it turns out is really the one who has a dog. Adopted little Edgar. Feel the very cockles of your heart grow warm. Feel them. Oh my God. Baby kitty.

So sweet as an Edgar Meowlin Poe. Is that who we have here?

Oh, my God, I hope so.

Adorable boy, Amanda. Very well versed in Alabama politics. I love this so much. Thank you for that whole rundown. That's so important. And congrats on your new baby, Keela. Katie. Next up from anonymous pronoun she and her Krista. Actually, never mind, it still was on the second line. I guess my good news is I live in Aotearoa. slash New Zealand. Although we have at the moment one of the most right wing governments we've ever had. Womp, womp. They seem to be playing from the Trump playbook. We have our elections November 7th, so hopefully they'll be voted out. Our electoral system is so much fairer than yours as we have proportional representation and hopefully we will get a left wing coalition government with a strong influence from the Green Party, which is polling the highest they ever have. Here is a photo of a native bird with its chick that hangs around our garden. It's called a weka or a weka. My cat doesn't even mess with them. They are a bird to be respected. They flip the bird at just about anything. Sparrows enjoying a bath is in the second picture. Look at these baby birdies.

Oh, my God. So sweet.

Adorable indeed.

All.

right, next up from Robert Pronouns, he and him. Hi, Allison. Hi, Dana. Hi, Beans Hind the scenes crew behind behind the scenes. Today I have a pod terror pick and a repurposed joke to share in the hope of raising the spirits of the entire beans crew in return for all you do. I knew I was going to make a donation to MSW Media Blue Wave Impact Fund at the start of this month, but today I decided to aim higher than I originally planned to. So I'm sending an anonymized screen cap of the receipt for that donation as my tariff. I'm repurposing an old joke and swapping out the walrus in favor of Kash Patel to continue the pile on this, recent FUBAR FBI ruling. I don't think it's much of a stretch because he seems kind of walrus. Y question. What do Kash Patel and a Mason jar have in common?

I don't know.

They both like a tight seal. All right, my inspiration. I came across the October 4th installment of Dr. Joanne Freeman's A Few thoughts for those who can't sleep. We're going to have a link to that in the show notes. It's a YouTube video. And while she affirms we are in the fight of our lives to save democracy, she still wants people to have courage and recognize that it is an honor to be called on in. In this way to work for your country. Invoking the message from Shakespeare's Henry. V. Is that right? And, ah. Saint Crispin Day speech. Saint Crispin Day speech. This clip just amplified what Heather Cox Richardson said to explain her current whirlwind travels to raise money for campaigns, saying that she's determined to not leave anything on the field this time. Yep, these things combine to inspire me to, and I quote, not leave anything on the field with regard to my donation. And there is a beautiful reception receipt for a $250 donation from this lovely listener.

Amazing. Robert, thank you very much. And wonderfully, repurposed joke.

Yep, indeed.

Next up from Karen. She and her hello lovely ladies of the lagoon. In these insane times, I find it helps to focus on friends and family. And to that end, I just got home from visiting my 101-year-old mom who lives in assisted living in Phoenix. She's a miracle of positivity, faith in God's plan for her, and grit and an occasional gin and taunt. If you've got my mom. I asked her if she's frustrating for her that her memories are fading. And she said, everyone says to live in the present. Well, let me tell you, I'm living in the present.

She said.

She's such a role model. Cheers to celebrating our seniors. They've been through more than we realize. And for my pet tax, I have my granddaughter, Wilson. He struggles with personal space. Hugs to the Bean family. Bean's family.

Karen, look at my God. Wow.

your mom is beautiful.

Gorgeous.

Oh, wonderful. 101 years old, Karen. Thanks for that. And thanks to everybody for your good news. Please send it all to us dailybeanspot.com click on contact. We got all the links in the show notes for you. Don't forget to vote for us for the Signal award. Cause like I said, I know Jon Stewart's great, but he's got enough trophies,

he's got enough hardware. He really does.

He does. and then also we have a link in the show notes to donate to Equality New Mexico, where there's only a couple days left to do that. So please do. And we'll see you all on October 9th in Albuquerque. Do you have any final thoughts? My friend.

No final thoughts for today. I just love you all. That's it.

Love you. Love you, too. I love everyone so much. Thank you so much for listening and welcome to all our new listeners. I know we just got a bunch of new listeners, so we really appreciate that you're here. All right, go check us out on Beans Talk and we'll see you here tomorrow. Until then, please take care of yourselves, take care of each other, take care of the planet, take care of your mental health and take care of your family. Vote blue no matter who who, and

take everyone you know with you and

vote blue all the way down the ballot. I've been ag. I've been dg and them's the Beans.
