Hello and welcome to the Daily beans for Tuesday, November 3, 2026. Today, the Supreme Court has denied the Trump administration's emergency applic in the California voter roll case. A federal judge has tossed the Trump administration's criminal charges against two former FBI officials over their testimony about Hunter Biden's laptop. Kennedy center leaders jeopardized the institution's operations by tying millions of dollars in funding to keeping President Donald Trump's name on its building. Alina Haba's husband is now under White House scrutiny for the deals they cut without Trump's knowledge. And the Trump administration plans to fly the Afghan immigrants from Louisiana to Pakistan, where they are expected to be expelled over the border to Afghanistan. Allison Gill is out for the day, so I'm your host, Dana Goldberg. Hey, everyone. Welcome, welcome, welcome. It is the day. It is. We've been building up to the midterms. You know this for a long time. Early voting has been going on for a while, but today is Election Day. I hope you have a plan. I hope you have voted early. And if you have not, text a friend. See what their plan is. Get your ass out to the polls and make sure you, you exercise your right to vote and save our democracy. As you heard in the, intro, Allison's out today. She's traveling. So you are with me behind the wheel in the pilot's chair. I don't even know what I'm saying right now. Still recovering from whatever cold I've had, which is why I have sexy voice. You are welcome, everybody. So let's waste no more time and let's just get into it. Let's hit the hot notes.

Hot notes.

All right, this first story is from the Times. The Trump administration asked the Supreme Court on Monday to require that California set aside 20,000 mail in ballots that the administration claims have been provided to noncitizens. We've been covering the story for a while. The emergency application to the justices came after a divided federal appeals court rejected the administration's arguments that California officials should impound the ballots for further scrutiny. Legal experts, they have been skeptical of the Trump administration's arguments in this, this entire case, let's just say it. Filing just one day before the midterm elections. It may forestall a ruling in the case and a potential loss for the administration. Thank goodness. Until after Election Day. The request is going to what it does. It requires the Supreme Court to consider how much power the federal government has to order states to make last minute changes to their vote counting procedures. Well, under The Constitution states have responsibility for administering elections, period. The Justice Department has claimed that it is in powered by a federal law that makes it illegal for noncitizens to cast ballots. So in their emergency application, lawyers for the administration urged the Justices to grant what they are calling a modest remedy requiring California to separate ballots of citizens and suspected non citizens. Solicitor General D. John Sauer wrote that such an order by the court, and I quote, it would not cancel any vote, but would allow time for verification of, the eligibility of suspected non citizens. While the Solicitor General appeared to distance the lawyers in his office, an elite division of the Justice Department that represents the federal government before the Supreme Court from direct knowledge of whether the people on the list were actually non citizens. Mr. Sauer wrote that his office, and I quote, has been informed that the United States has identified more than 20,000 individuals who appear to be registered to vote in California and who in the United States view, are likely not U.S. citizens. We've already proven with other stories that this is complete bullshit, by the way, by an astronomical amount of these 20,000 individuals. California leaders denounced this election eve appeal to the Supreme Court. The state's Attorney General, Rob Bonta, who thank goodness is a Democrat because voting down ballot matters, said in a statement that the administration's filing reeks of desperation, calling it another attempt to undermine our elections and trample on the rule of law. And a little bit of breaking news. No public dissents, by the way. And without even calling for a response, the Supreme Court has denied the Trump administration's request for emergency relief in this case. Boom. Excellent news. End of story. Thank goodness. So, you know, the shenanigans are going to be high. They're going to, I think probably almost every election they lose say that it was stolen or they're going to ask for a recount or they're not going to concede. There's going to be a lot of lawsuits. So whatever happens, by the way, tonight, if you're listening to this on Tuesday, just remember we may not have answers this evening, but we will get answers. So be patient. We've got a next story. This one's a pretty related story. This one's from Politico. A federal judge in Washington, D.C. has barred the Trump administration from demanding that California officials set aside ballots from up to the 20,000 registered voters who federal agencies have deemed likely to be non citizens. This is a continuation of the story. And I quote, the executive branch has likely violated the Constitution's election clause, which, which commits authority over election rules to the States and Congress alone. Chief U.S. judge, District Judge James Boasberg wrote Monday, and I quote, california may decide for itself what procedures to use for verifying the citizenship of registered voters and deciding whether to count their mail in ballots. California gets to decide everyone. We've known this. And he says defendants flawed lists risk chilling or preventing lawful votes from being cast and counted. Boseberg's decision overlaps with a similar order issued by U.S. district Judge Trina Thompson, who's also a California based Biden appointee who barred the Justice Department on Friday from making demands of any state to separate ballots based on claims of purportedly ineligible voters. The Justice Department has of course, appealed Thompson's order and has asked her to put it on hold during that appeal. During a hearing Monday in San Francisco on that request, Thompson sounded troubled by concessions from a Justice Department attorney that the list being sent to voting officials aren't completely accurate. And I quote, it may not be a perfect list. That's what Assistant U.S. attorney Kenneth Kao said. Listen to this. If I'm hearing that the list is flawed and it's over inclusive and includes individuals who are eligible to vote, that's a problem. This is from the judge. Would you agree there's a high error rate? And the answer, I think that's a fair statement, kao said, adding that the federal officials hope state and local authorities would check it against their own data to help ensure the purity of the vote. So they're just giving them this fucking list and giving and leaving it up to the states to do their due diligence to prove that these are either correct or they're wrong, which is just crap. Boasberg's ruling came in litigation brought by a civic group that contended many of its members were likely on the Trump administration's list in California. The Obama appointed judge granted the group, which is the Coalition of Human Immigrant Rights, access to the list, and a pair of data scientists tapped by the group concluded it included a significant number of erroneous names. So they said, go ahead and check them and the state said, great, hold my beer, checked them and was like, this list is boring. So I'm glad that this keeps happening and I'm glad they keep fighting it. We, got a story up next from Reuters. A federal judge on Monday tossed out a criminal case accusing two former senior FBI officials of lying about their involvement in investigations into former US President Joe Biden's son Hunter, excoriating the Justice Department for bringing as what he described as a political prosecution. Before Tuesday's midterm elections. The and I'm happy with this. And U.S. magistrate Judge Zia Faruki threw out the case at a remarkably early stage, finding that prosecutors had not shown sign sufficient evidence that the two officials, who are Nikki Flores and Bradley Benavides, had knowingly made false statements. What has transpired here cannot be described as anything other than weaponization of federal law enforcement. That's what she said during a court hearing. Allison and Andy, by the way, are going to cover this in depth on this weekend's episode of Unjustified. So make you listen to that episode because you know, they always do an in depth and it's always fantastic. Now this next story I am very happy to report it's from Aaron Reed at Aaron in the Morning, who we love as a source on this podcast. Abdul, Syed, as we know, is a Democratic candidate for U.S. senate in Michigan. He has long been a vocal ally to transgender people. In the 2026 midterms, he has not wavered in that support, despite the hundreds of millions of dollars in attack ads, much of which has been focused on transge people that have poured into this year's elections from the Republican Party and even at times from the Democratic Party as well. Rather than capitulate to those ads as, some Democrats have done, El Sayed has defended transgender people outright on sports, on education, on healthcare. That was certainly True in his 60 Minutes interview released Sunday in which Ross dual fat. I think that's how Ross says his last name, Dual Fat. By the way, he's a conservative columnist that Barry Weiss brought to the program summer, and he was pressing him multiple times on the support of transgender people. This whole interview is such bullshit because he was like softball questions the Republican. And then he goes in after El Sayed. And you can just see the bias in this interview. So the interviewer started with a question as to whether El Sayad's faith puts him in conflict with, and I quote, a very socially liberal and culturally liberal party listing abortion, same sex marriage, transgenderism, which isn't a word as issues on which a lot of Muslims like a lot of Christians, hold conservative positions. Notably, and I'm putting this in quote, transgenderism is a far right term used to frame transgender people as an ideology rather than a class of people. Now, in doing so, those who use it, they use to seek the pan, the transgender people's existence as a matter of faith or belief rather than a fundamental characteristic of a person. In its most extreme form, the claim is that gender itself does not exist. So El Sayed, then rejected the premise that his faith puts him in conflict with the values of a secular, liberal society, pointing instead to the importance of standing up for all people's rights. And this is a direct quote. I believe in rights. And even though somebody might use rights that you don't understand, you never mean to use yourself. You still got to show up and fight for those rights. And that's the thing about this moment. I think it's responsibility for us to stand up against the risk of a government making incursions on any of our rights to build the kind of continuum, the kind of coalition where any of us and all of us who have our rights at risk are standing up and fighting for all of our rights. And I think this is an important responsibility. So in conversations with folks in the Muslim community, conversations with folks in the LGBTQ community, the point I always make is to say, listen, I don't care whether or not you will ever use a right that you were fighting for. Understand that a failure to show up and fight for that right is a failure to show up and fight for your own right. That's a great quote. Now do that. I think that's his name. Again, attempted to just basically pin El Sayad down on transgender people, asking, and I quote, what about the rights of parents to control over their children's education? Because a lot of places where there's tension between Islam and Muslim voters and what I'm calling cultural liberal liberalism are around issues like what is taught in school, what happens with transgender kids in sports teams, and so on. Right. Like, these are places where rights are in conflict. Right. What do you think happens there? Well, Al, Sayad forcefully rejected it, pointing out that it is unrealistic to expect that kids will not learn about transgender people in the age of the Internet. And this is a quote, the notion somehow that you're going to prevent your child from being exposed to something that you may find disagreeable, and that that is going to be because of the school, so profoundly outdated. Because, of course, you have all the information, and they have all the information. So here's the thing about it. I think it's really important for us to reorganize that. The free flow of information is actually a beautiful thing. It's really important. And the most important thing you can do is, is not try to protect a person from seeing a thing. It's about trying to make sure that as you coach your kid through the world, that you are engaging with them and saying, here's what I believe. Here's what you may see in the world. And you get to make your own choices about who you're going to be in the world. You can read this entire report, by the way, and watch the entire segment on Substack at Aaron in the Morning. And I, encourage you to do it. It's a really great, I don't want to say it's a great interview because the interviewee, the interviewer, excuse me, piece of garbage. But El Sayad handles himself incredibly well. This next story, everyone is from the Times. The Trump administration has detained dozens of Afghan immigrants in Louisiana and plans to deport them to Afghanistan, according to three U.S. officials. The group includes people who could face discrimination or persecution under the Taliban, including relatives of people who helped the US Military and at least one gay man. More than 150 Afghan immigrants are expected to be deported. This is from one official making this one of the largest single expulsions of Afghans. By sending them to Pakistan, which would then send them to Afghanistan. The Trump administration has found a way around the hurdles that have so far prevented vulnerable Afghans from being sent back to face repression or retaliation by the Taliban. Lacking diplomatic relations with the Taliban, the United States cannot arrange deportations to Afghanistan. And some Afghans living in America, they've been granted legal protections from US Judges which prevent them from being sent back to Afghanistan because of the persecution that they would likely face under the Taliban government. The officials say that deportation is in effect to Afghanistan, and that is what the detainees have been told by ice. But Pakistan is going to oversee their expulsion over the border to Afghanistan. U.S. law prohibits the government from deporting people to countries where courts have ruled they would most likely face persecution. It's not known if any of the Afghans being sent back in November have such court protections. The United States has not announced the deportation plan, by the way, elements of which were first reported by Bloomberg. The New York Times pieced it together. They pieced it together through interviews with lawyers for some of the people detained and with three US Officials, who of course, spoke on the condition of anonymity. The Times also obtained documents to verify Muhammad's criminal history, marriage, and the plan to deport him. Specifically, court filings for one of the Afghans indicate that he has been put on a manifest for a special chartered flight that leaves Alexandria, Louisiana. During the first week of November, lawyers representing the two other Afghan immigrants shared emails from federal officials informing them that their clients would be deported to Afghanistan in early November. In recent days, the Afghan immigrants have been moved from detention centers all over the country by U.S. immigration and Customs Enforcement to immigration detention facilities in Louisiana. Detainees and lawyers said that they were given little information other than that they were being sent to Afghanistan. I tell you, this fucking administration will find every loophole they can just to deport people that they don't like the color of their skin, that they don't like their creed or color or, in some cases, or sexual orientation or gender identity. And I say that because there are a lot of LGBTQ immigrants that are being targeted right now. So we'll keep you updated, of course, on this story. And, we're going to move to some DC News. This is from the Post. Kennedy center leaders jeopardize the institution's operations by tying millions of dollars in funding to keeping Donald Trump's name on that building. This is from a Democratic congresswoman who serves on its board, and that's what she alleged in a court brief filed Tuesday. The Trump Kennedy center for the Performing Arts Foundation. Again, that's not what the center is called. It's a foundation created to raise money for the institution. What it did is it transferred 17.5 million to the center this year. And that's according to the brief prepared by lawyers for Rep. Joyce Beatty. She's an amazing Democrat from Ohio. According to a Trump administration lawyer, that money came on the condition that the center be named after Donald, a condition that bar it was barred by federal judge in May. They said absolutely not. Internal messages quoted in the document described a paralysis that followed, with officials warning that returning the money would force immediate furloughs of Kennedy center staff. Commerce Secretary Howard Lutnick. Piece of garbage. Rejected a request to let the center keep some of it without the name requirement. That's what the document said. The Trump Kennedy center for the Performing Arts foundation was created before Trump's takeover of the center and since rebranded with his name. The latest allegations suggest that the money intended to support the center became leverage in the effort to keep Donald's name on the building. The foundation's finances have become part of a broader dispute over plans to close the Kennedy center for two years of renovations. Beatty is asking U.S. district Judge Christopher Cooper to maintain his order blocking the shutdown. Her lawyers argue that officials manipulated the information presented to trustees to secure approval for Trump's closure plan. They contend that leaders put his interests ahead of the centers, threatening its finances, while citing financial problems as a reason to close. All of this, to me, is true. It's going to play out in court. Obviously, I think we know it. We've seen the receipts on this, and this is, this stuff's going to keep happening. I mean, everything they touch, they break. And I really hope that eventually we can get this building back and get every fucking person that is even remotely close to Trump out of the board, out of the building and take back the center for the Arts because it's an extraordinary legacy, to an extraordinary man. So. All right, everyone, those are the hot notes. I know you're sticking with me. We're going to take a quick break and they will be back with the good news after these messages. Will be right back. This is awesome. This is great. Good trouble. Spread it far and wide. All right, next up from Michelle B. Pronoun. She and her just important note to all voters, a provisional ballot is your last resort. Do whatever you can to rectify your status so you can vote a regular ballot so it counts immediately. If the choice is between being unable to cast a vote or casting a provisional, take it. But sometimes the poll book has an error or you're at the wrong polling place. Do whatever you must to vote a normal ballot, if at all possible. In Pennsylvania, for instance, your vote may never get counted. This was my training as a poll watcher and now I actually work the elections and I do everything in my power to make sure I help a voter cast a normal ballot. So every vote counts and this is in italics. how are provisional ballots counted in Pennsylvania? Within seven days after the election, the county board of elections will decide whether you were eligible to vote at the election district where you cast the provisional ballot. If you were eligible, they will count your provisional ballot. I do have a source, so there's a link in the show notes for anyone who wants to read about that. For podpet tax, I give you Oliver, AKA the Viper, because he'd be sweet until he changes his mind and nips at you, aka pip, numbnuts, shadow always behind me. Thanks AG&DG and Kanai and all the lagunati for all you do to help us restore sanity in these dark times. Vote blue. Michelle, thank you so much for this. All the information, whatever you can do as often as you can vote a normal ballot. All right, next up from Christina that pronoun. She and her good news from Ruby Red, Idaho. Yes, really. Hi Beans Queens. I'm writing this down now because on November 4th I'm going to need a reminder of how many amazing people showed up for this state. It started two years ago with a ballot initiative to restore reproductive health care in Idaho. Thanks to our GOP super majority, getting one on the ballot is a total shit show. If you haven't read about the cruel trigger ban on abortion our state has endured, there are great news articles everywhere about the horrors. Basically, our trigger ban has no health exemption unless you're practically dead and doctors who step in too soon face prison fines and losing their license. Women are going septic, doctors are fleeing and labor units are closing. So we did the work. All grassroots roots, all Idahoans, all volunteers. Prop 1 is on the ballot. Then the two biggest churches showed up and the lies and m millions of dollars started. Our Catholic bishop is ringing church bells to wake people up to vote against women's health. Under the gist it saves lives while we're life fighting people out of state to get safe care. This cradle Catholic is boiling and I would happily kick that bastard in the nuts. But I promise good news. So here's the good news. We have incredible in nearly every race and almost every one of them is a woman. Not placeholders over qualified badasses. And here they are. Kaylee Peterson, a multi generational Idahoan. It matters, especially with all the California R's who moved here for political refuge during the pandemic. And they are the worst. Has driven 120,000 miles the length of her district from Canada to Nevada, building coalitions and communities. Her GOP incumbent, he's breaking bread with literal Nazis at fundraisers and selling off our public lands. We've got Dr. Becky Sandeen Mitchell, Teacher of the Year, PhD, mother to a special needs child, running for superintendent. Terry Pickens is a lawyer, multigenerational Idahoan running for governor. Lori Hickman, LDS mom, attorney who has practiced law in big cities and a PTO volunteer run running for ag. I name them all. But I've got a door to knock. I'm a district chair, campaign organizer and voter protection director. Mother and a social worker. Yeah, I see why I'm frickin tired. I can see why you're tired too, by the way. You were killing it. But it's everyone here stepping up in all the ways, running for office, hosting events, reaching voters, organizing ICE watches in our minority communities. This list of what we are doing is long. We're cautiously hopeful. We're leaving nothing on the table in this ruby little sleep state. Neither should you if you're not tired. You're not working hard enough. The election ends on Tuesday, November 3rd and we can take a Rest then before we gear up again for my POD Pet tariff. I'm attaching pictures of our rescue Barn kittens as they play with our old lady kitty. They were fluff balls when we got them this spring and it brought immense joy to my family. Meet little Juan Kiko and Squirmy Noodle. These kittens are really freaking cute. Christina, this is awesome. You are doing so much. I am proud of you. I know the list listeners are proud of you and I know you're proud of yourself. So I like that good news and the self shout out all in one. Next up from Heidi Pronoun. She and her hello AG and dg. I started asking friends and family how can I help you get out to the polls last week. I've now given two rides with one more planned and I've taken a friend's child to their after school activities so mom can go to the polls. It takes a village. As POD Tacks have attached a photo of the sunrise over Alba Albemarle Albemarle Sound. Someone sended a correction on that Albemarle sound earlier this fall. Heidi, this is awesome. I'm telling you everyone, if you ask somebody do you need help? Some people will say yes because they don't know how to ask for help and they don't have a plan. So take the risk. Text a friend you need some help today? I'll give you a ride. Next up from Janice Pronoun. She and her Greetings ladies of the beans. You are both amazing. Thank you. I'm in my second term as a Democrat precinct committee person. Right now I'm doing what they call ballot chasing. That means that I'm calling Democrats that received a mail in ballot but have not returned it. After ballots are received, their names are removed from my list. Please, please, please return your ballot in a return box. Not via the postal service, not a post office mail. If for no other reason than to get me to stop calling you. Trust me, I will continue to call you. Also, I've attended a class to brush up on my skills as a poll watcher. I've been telling myself for the last three elections that this is the most important election of our country's history and it continues to be true. The most important thing you can do for our country is to vote against the Trump regime. I'm a poll watcher again because I'm afraid there's going to be bullshit by the Republican Party to interfere with our elections. I want to thank the election judges. They are not the problem. In my experience Both Republican and Democratic judges do a wonderful job and it's a very long day for the them. For my pot pet tariff are pictures of my kitty dozer. Even though he is a full blooded Maine coon and weighs 19 pounds, he's a shelter cat. He is my foster fail. This is his third home. He has been abused and it has taken him six months for him to come out of his shell and let his amazing personality shine. Look at that baby. Thank you so much for that submission Janice. Thank you, thank you, thank you. All right, next one from Diane Pronouns. She and her hello AG and DG companions of my morning commute. It was a beautiful night in Georgia Wednesday night with an overabundance of attendees for the John Ossoff Keisha Lance Bottoms rally with Obama. The line snaked halfway around South Lake Mall just south of our Atlanta Perimeter highway with thousands of people hoping to get in. We had all ages, all colors, various persuasions and generally good and supportive atmosphere. I was happy that such a crow came out to support our gubernatorial candidate and Senatorial incumbent and to see and hear Obama and his commentary. Gotta love his insights. If you haven't seen the video of the rally, please go find it on YouTube. I particularly liked his discussion of how bent out of shape the Republicans were about Obama's joke about the Cheesecake Factory. Alas, I did not make it into the rally so I'm sharing a combo pic of the lines that I took while trying to find the end of the line. Also sharing a backlit pic of an on the move deer from my early morning walk on Wednesday. River politely looked and did not growl. Love to you both and all the back court. Look at these lines. This is awesome. Also, this is a very cool picture of this backlit deer. Amazing. Still has little antlers on them. All right, next up from Nan Pronoun. She and her hello to the best beans ever. I wanted to share my crazy Ulster County, New York voting stickers with you. The top one is this year's selection. They have a contest with local children and I pick a different one every year. The buttons were given to us by friends we made earlier in the voting line. The bottom stickers are from the past years. I've attached my sweet mochi cat who back in the late 2017 at the ripe old age of 23. What a life. Crossed the Rainbow Bridge. She lived through three consecutive doggos with me. She was a special girl. I still miss her. Thanks for all you do. You have created the most wonderful community here and I'm happy to have been part of it since the early Kitchen T table days. Look at these stickers. I love when stickers are created by kids. It gets them started really early on in this whole democratic process. In my opinion, it's absolutely brilliant. All right, next up from Nancy Pronoun. She and her. Today is the day we have the privilege and responsibility to vote, make our voices heard. The sign has been my front yard for a month. We can complain, we can hope, but voting is the only thing that counts. My rule, you don't vote. You can't. Here are my two daily inspirations of goofy laughs. On the left to right, I have Rufus, who's a blank and Opie, short for Opus because he's a piece of work and a blank. Good trouble with eight legs and one and a half tails. Oh, my gosh. Okay, on the left, I want to say we've got, like, Rufus is a. A hound of some sort. I don't even know if he's a mix. And, Opus looks like a boxer. Let's see what we have. We've got a hound dog for Rufus and a boxer. Allison, I love you, but I am one for one on what the mutt. Actually, I miss my co host, but I got him right. All right, next up from Sukhan, pronouns, she and her. This is a shout out to my daughter Anna. I hope we are experiencing Halloween costume today. This is awesome. Look at this blue wave taking over the Titanic. This is so good. Oh, my gosh, I love this. I love creative Halloween costumes. If you want to send those in for your good news, I'd love to see those too. Anything that made you laugh, anything that you loved, anything at all for the good news. It really gets us through the episodes and it's just a nice palette cleanser after all the bullshit in the world. So Allison will definitely be back with us tomorrow. If you're listening to this and you're going to be at the San Diego watch party, Ha. Have so much fun. Just be in community. No matter what happens, you're going to be in community, and that's a good thing. So until tomorrow, take care of yourself, take care of the planet, take care of your mental health, take care of each other. Please do not vote red or we'll all be dead. Remember to vote all the way down ballot. Allison will be back with me tomorrow. So I've been your host, dg, and them's the Beans.
