Yeah, so that inspector general report came out saying there were exactly zero FBI agents at the Capitol, but there were 26 informants, like criminal informants to the FBI. Right. Confidential human informants who were just there because they're, they're so like, this guy is trying to get this Trump judge to be like, I'm totally innocent and you need to drop my case because there were confidential human sources there that day that they're responsible for the, for the riot, not me. So you would, you will read what the judge has to say about it. It's pretty great. How are you today, Dana?

 

Uh, I'm good. By the time everyone hears this. Um, actually, no, that'll be tomorrow. I'm excited about tomorrow, which is today. When you hear this, I've never actually been in the White House. I've been in the Library of Congress. I've been in the Capitol on the Congressional floor, but I've never been in the White House. And I get to go there with you tonight. And I'm very excited. Actually, this afternoon it's like at 3:00.

 

Yeah, I think they do. I think they have three holiday parties a day during December. Amazing. Like, they have an 11 to 2, a 3 to 6 and a, like a 7 to 10.

 

Like, oh, my gosh. Well, I imagine there's thousands and hundreds of thousands of people that, you know, between over the last four years, like people's families and people of note and blah, blah, blah, blah, blah, blah, blah.

And, um, I think they have multiple. Multiples of that particular party as well, because I know some of my other digital creator friends are going tomorrow. And then Dan Goldman had a party and then there was some for the Capitol Police officers to yesterday, as you're listening to this today. So there's just a million different things and it's so crowded here in December, uh, on Capitol Hill, um, the, you know, the legislature's still in session, so, yeah, they're fully staffed. And. And then you've got everybody coming in for the holidays, but. And then the Army Navy game on top of that. It was just.

Yeah, really busy weekend. So anyway, I'm looking forward to going as well. And, um, I'm glad that, uh, you're gonna get to go before, you know. Huh?

Um, honestly, wouldn't be surprised.

 

No. Right. Nothing surprises me. Like I put this wild and crazy conspiracy theory on Blue sky yesterday. Like, I think, I bet, I bet Elon Musk is behind all the drones and it's, um, it's some sort of money making scheme for him. And, and everyone's like, you know what, I can't call you crazy.

 

No.

 

Like, yeah, I know it's pretty scary. Uh, as is the news, which we have to get to. So let's do that. Let's hit that. Note, hot notes. All right, first up, from Jarrett Renshaw at Reuters. The Trump transition team wants the incoming administration to drop a car crash reporting requirement that's opposed by Elon Musk's Tesla. That's according to a document seen by Reuters, a move that could cripple the government's ability to investigate and regulate the safety of vehicles with automated driving systems. Musk, the world's richest person, spent more than a quarter of a billion dollars to help Trump get elected in November. Removing the crash disclosure provision would particularly benefit Tesla, which has reported most of the crashes, more than 1500, to federal safety regulators. Under this program, Tesla has been targeted in the National Highway Traffic Safety Administration. That's the NHTSA investigations, including three stemming from these data. The recommendation to kill the crash reporting rule came from a transition team tasked with producing a 100 day strategy for the automotive policy. The group called the measure a mandate for excessive data collection. That's in the document that was seen by Reuters. So they're like, yeah, it's just excessive data collection.

 

You know what needs to know if our cars are causing accidents.

And you Know me, I've been talking about my fear of this administration, in addition to how many deaths they're going to cause, is that we won't know how many there are because they won't.

 

Tell us exactly the COVID up.

 

This is one of those things. They want to get rid of this reporting requirement because they say it's excessive data collection. Yeah, who, who wants to know stuff?

 

Sorry. How many accidents has my Tesla been in my brand? Oh, none. No accidents. It's never been in an accident. It's not going to tell you anyway.

 

Yeah, we're not going to tell you. The Trump transition team, Musk and Tesla did not respond to requests for comment. Reuters could not determine what role, if any, Musk may have played in crafting the transition team recommendations or the like likelihood that the administration would enact them. I'm sure that that was part of what the money was for it. You know, I'll, I'll, I'll spend one, uh, hundred ten million on a ground game for you and give away lottery stuff and spend another hundred million. But you got to take these reporting requirements away. Yeah, and regulations. Right. I mean, it's obvious to me. The alliance for Automotive Innovation, a trade group representing most major automakers except Tesla, has also criticized the requirement as burdensome. A Reuters analysis of the TSA crash data shows Tesla accounted for 40 out of 45 fatal crashes reported to the NHTSA through October 15th. Among the Tesla crashes that they investigated under the Provision were a 2023 fatal accident in Virginia where the driver, using the car's autopilot feature, slammed into a tractor trailer, and a, uh, California wreck the same year where an autopiloted Tesla hit a fire truck, killing the driver and injuring four firefighters.

 

Geez.

 

NHTSA said in a statement that such data is crucial to evaluating the safety of emerging automated driving technologies. Two former TSA employees said the crash reporting requirements were pivotal to agency investigations into Tesla's driver assistance features that led to 2023 recalls. Without the data, they said, NHTSA cannot easily detect crash patterns that highlight safety problems. NHTSA said it has received and analyzed data on more than 2,700 crashes since the agency established the rule in 2021. The data has influenced 10 investigations into six companies, as well as nine safety recalls involving four companies. In one example, NHTSA fined Cruise, which is a self driving startup owned by GM, $1.5 million in September for failing to report a 2023 incident in which a vehicle hit and dragged a pedestrian who'd been Strzock by another car. GM said this week it would end robo taxi development at Cruise and fold it into its group working on driver assistance technology. NHTSA is so called standing general order requires automakers to report crashes if advanced driver assistance or autonomous driving technologies were engaged within 30 seconds of impact, among other factors. In addition to ditching the reporting rule, the recommendations call for the administration to liberalize autonomous vehicle regulation and to enact basic regulations to enable development of the industry. In an October Tesla earnings call, Musk called for a federal approval process for autonomous vehicles rather than a patchwork of state laws that he called incredibly painful to navigate. He wants to take it away from the states and make it federal, uh, that these regulations be barred to try to disallow the states like California from requiring it. Right. And, and he'll do that with a supremacy clause because you know, he owns the Supreme Court. After the election, Trump named Musk the co lead of a newly created Department of Government efficiency dodgy right to advise from outside government on slashing federal staff. Tesla is among the most prominent automakers developing advanced driver assistance features which can assist with lane changing and driving speed and steering. Tesla's Autopilot and full self driving systems, which are not fully autonomous, have come under intense scrutiny in lawsuits and a Department of justice criminal probe examining whether Tesla exaggerated its vehicle's self driving capabilities, misleading investors and harming consumers. Trump's Department of Justice will drop that, I'm sure. Tesla despises the crash notification requirement, believing that NHTSA presents the data in ways that mislead consumers about the automaker's safety. So the crash reporting misleads us into thinking that Teslas aren't safe. Mhm. Well they're not. This is according to two sources familiar. Tesla executives discussed with Musk the need to push for scrapping the crash reporting requirement, according to one of the sources. But because Biden officials expressed enthusiasm for the program, Tesla executives ultimately concluded that they would need a change in the administration to get rid of the requirements, according to a source. Tesla finds the rules unfair because it believes it reports better data than other automakers, which makes it look like Tesla is responsible for an outsized number of crashes involving advanced driver assistance systems. NHTSA cautions that the data should not be used to compare one automaker safety to another because different companies collect information on crashes in different ways. Bryant Walker Smith, a UH University of South Carolina law professor who focuses on autonomous driving, said Tesla collects real time crash data that other companies don't and likely reports at a far greater proportion of the incidents than other automakers. Tesla also likely has a greater frequency of crashes involving driver assistance technologies because it has more vehicles on the road equipped with them and drivers engage the systems more often. Now that means the vehicles may more often get into, quote, situations that they aren't capable of handling, he says.

 

Thank you so much, Ag and we're going to head up north to, uh, Toronto with Amanda Coletta from the Post Justin Trudeau's chief lieutenant throughout his tenure as Canada's prime minister, resigned from his cabinet on Monday, citing differences over how to confront President elect Donald Trump's America first economic nationalism, threatening tariffs and a possible trade war. The abrupt resignation of Christia Friedland, who served the past four years as both finance minister and deputy prime minister, is the latest blow to the embattled Trudeau, whose popularity has nosedived over the past year. If federal elections were held today, polls project a wipeout of his Liberal Party. In her resignation letter posted on Freelands and I apologize early, I think I said Friedland's Freeland's Twitter account Monday morning, shortly before she was scheduled to deliver a fall fiscal and economic update at Parliament. Freeland says Trudeau told her that and no longer wanted to serve as his financial minister and offered her another cabinet role. And I quote, upon reflection, I have concluded that the only honest and viable path is for me to resign from the cabinet. That's what she said. Went on to say. To be be effective, a minister must speak on behalf of the prime minister with his full confidence. In making your decision, you made clear that I no longer credibly enjoy that confidence and possess the authority that comes with it. Now Freeland, a former journalist whom Trudeau named foreign minister in 2017 as part of a cabinet shuffle designed to prepare the government for the first Trump administration, said that for several weeks she and Trudeau had been, quote, at odds about the best path forward for Canada, including how best to respond to the grave challenge posed by US President elect's threatened tariffs of 25% on Canadian imports. Canada sends three quarters of its exports to the United States, and economists project that such levies could plunge Canada into a recession. And I quote, we need to take that threat extremely seriously. This is again, Freeland said that in a statement. That means keeping our fiscal powder dry today so we have the reserves that we may need for a coming tariff war. That means eschewing costly political gimmicks which we can ill afford and which make Canadians doubt that we recognize the gravity of the moment. Freeland did not elaborate on what she considered to be, quote, costly political gimmicks. But last week, the Globe and Mail reported on a growing rift between the Finance Department and the prime minister's office over a sales tax exemption that took effect over the weekend, as well as plans to send $250 rebate checks to some Canadians. Some political analysts called the move a last ditch effort to win back voters. The Globe and Mail reported that Finance Department officials opposed such spending because it would jeopardize Freeland's pledge to keep the deficit capped and no more than $40.1 billion. She was expected to miss that target in the fiscal update Monday. Freeland said in her resignation letter that Canada can deal with the threat posed by Trump's tariffs if it is strong, smart and united. After Trump's election in November, Trudeau revived a cabinet committee on U. S. Canada relations and put her in charge. But when the prime minister jetted off to Mar a Lago last month to dine with Trump and attempt to dissuade him from imposing tariffs on Canada and treaties that have thus far failed to push the president elect to reverse course, he did not take Friedland with him. Now, the Trudeau government earlier this year announced the revival of so called Team Canada approach to prepare for the US Election, dispatching several high profile officials across the United States to build relationships with U.S. lawmakers, business leaders and people close to Trump to stave off policies that could harm Canadian interests. Political leaders here have been divided on the best way to respond to the tariffs, including on whether to impose retaliatory levies. Now, Ontario Premier that's Doug Ford has threatened to terminate energy exports to the United States, Canada's largest trading partner, by the way, a move that Quebec Premier Francois Lagul and Alberta's Premier Danielle Smith, they have both opposed. Saskatchewan, uh, Premier Scott Moe has urged Trudeau not to consider imposing export taxes on commodities such as uranium and potash. So this, we're going to see a lot of this. We're going to see a lot of this coming. Canada, China, Mexico. There's going to be conversations about this ongoing and we'll keep you posted on what's going on with the tariffs. For sure.

 

Yeah, for real. All right, next up, Kyle Cheney is reporting this over on Blue sky that a Trump appointed judge, Judge Kelly, he wrote this decision because like I said, a January 6 came to him and said, hey, I'm innocent, because there were 26 informants at the, at the Capitol on January 6th. He says first, Wanek argues the undisclosed presence and identities of FBI confidential human sources could have supported an entrapment defense. But he has no facts to back up that theory. He offers no evidence or reason to believe that anyone, whether or not that person was an FBI confidential human source, induced him in some way to commit the crimes for which he was convicted. He offers no evidence or reason to believe that he spoke to or interacted with an FBI confidential human source on January 6th. And he offers no evidence or reason to believe that an FBI confidential human source induced anyone to commit a crime that day, let alone that a source did so at the FBI's direction. So, as the government argues, he offers no evidence or reason to believe that the presence or the identities of any FBI confidential human sources present could have impacted the court's conclusions about his intent, knowledge or conduct, such that those identities might be Brady evidence. That's exculpatory evidence. What he does have is speculation, guessing that FBI agents or informants could have potentially shaped his behavior if they interacted with or observed him. But, uh, that's not enough. In his motion and in sentencing hearing, Weynick gestured at several persons who he asserted might have been FBI confidential human sources and quote, individual in a red hat and a camouflage backpack, unquote, whom officers were trying to detain and whom Wanek tried to pull away from them. A person who kicked a hard sided construction marker that ended up in Wayneck's hands, he then chose to throw at officers and a woman who started asking questions inside the capitol, to which the defendant responded, were an imminent threat to the people inside. Uh, so then it goes on to say, but again, a close review of the records reveals no evidence. Can you believe that? Like some guy in a hat kicked a thing and that ended up in my hands and then I hit cops with it. See, like what? Um, the record reveals no evidence or reason to believe that any of these persons induced him to commit the crimes for which he was convicted or was an FBI confidential human source. Indeed, the last of these persons interacted with Weynick after all his crimes were completed and the court at sentencing did not materially rely on the statements he made to her, which merely stated the obvious at that point. Wanek also argues that the information is highly relevant to impeaching the government witnesses who testified about his conduct that day. But he doesn't explain why. There's no basis to think that the presence of an FBI confidential human source could be, uh, you know, an issue. Wanek also does not explain how an entrapment defense would have been viable given the ample evidence of his predisposition to commit the crimes for which he was convicted. C USV Glover, 1988. Even before he interacted with the three persons described above, he had arrived at the Capitol dressed as if prepared for violence, joined by the mob that breached the restricted perimeter of the Capitol grounds and along with other rioters, physically confronted police officers protecting the Capitol building. So this was pretty, pretty hardcore bench slap, but just the whole. A guy in a, uh, hat kicked a thing that ended up in my hands and oops, I hit a cop with it.

 

I had to put it somewhere so I threw it on a cop.

 

Clearly that was an FBI confidential human source that was trying to entrap me. Yeah.

Yeah. The imagination of some of these people. I hate that I even have to report this next story. There's a trigger warning for yet another school shoot shooting. This is from ABC News. Two people were killed and six others have been hurt during a shooting at the Abundant Life Christian School in Madison, Wisconsin. Police had briefly mentioned a higher death toll but later revised the information. The suspect, a juvenile who used a handgun, is also dead at this time. This is from the police. The suspect is believed to be a student. Victim's injuries range from minor to life threatening. Officers responded to active shooter report around 10:57am no officers fired their weapons. This is again from the Madison Police Department and I quote, I never saw so many police cars in my life. Just blue and red lights lining the school, lining the streets, fire departments, paramedics, everyone was there. They were swarming the usually quiet neighborhood. This is from John De Leon. He told ABC News Live he said he saw officers with long guns at the scene and other students run from the school across the parking lot. Quote, later on, very slowly, in more orderly fashion, the younger students holding hands were let, were let out to go across the street, uh, across to the parking lot. Officials are working to reunite students with their parents. About 390 students from kindergarten through 12th grade attend that school. Jill Underlee, Wisconsin Superintendent of Public Instruction, stressed the need for change, saying in a statement, quote, this tragedy is a stark reminder that we must do more to protect our children and our educators to ensure that such horrors never happen again. We will not rest until we find solutions that make our schools safe. Quote, the time for change is long past. Wisconsin Governor Tony Evers wrote, quote, I am closely monitoring the incident at, uh, Abundant Life Christian School in Madison. We're praying for the kids, educators and the entire Abundant Life school community as we await more information and are grateful for the first responders who are working quickly to respond. Senator Tammy Baldwin, she's a Democrat from Wisconsin. She tweeted, quote, I've been briefed on this active school shooting at Abundant Life Christian School in Madison. And my heart goes out to all those impacted. My office is in touch with local and state officials and I stand ready to assist law enforcement and anyone affected. Senator Ron Johnson, the Republican from Wisconsin, he wrote on social media, quote, my sincere condolences and prayers for all the victims of the tragedy at the Abundant Life Christian School. I will continue to closely monitor the situation. President Joe Biden has been briefed on the shooting. That's according to the White House. Just a, uh, little point. Just want to show you right here that Ron Johnson from Wisconsin mentioned nothing about needing change, just sending again thoughts and prayers.

 

Yeah, uh, it's just such a tragedy. You had a really great post, uh, on Blue sky today about gun violence. Thank you, DANA.

And now, you know, read that, think about that and then think about how these school age children feel and the teachers having to return to school. It's horrifying. And still they do nothing.

If that means that they want to be with you every minute of every day, it's pretty much spot on. He's very playful and insanely intelligent. He's my alarm clock. I retired from teaching three years ago and spent much of my time painting, often with Jack perched on my shoulders. Mark, look at this baby angel. Oh, thank you for the information on the Manx. My first cat was a male Tabby Manx and was 5 months old when I adopted him. His former family told me he was part Russian Blue. He lived for 23 years and I still grieve his passing. My second cat was a Manx 2, the beautiful female Calico. I would find both of them sleeping under my armpits every morning. Great cats as all of my cats were and are. Look at these babies.

Love this. All right, this is from Ken B. Dear Beans, Queens, I'd like to give a shout out to my wife who I first met a little over two and a half years ago. We had each lost. We had each lost our spouse of 40 years and she found me online. We rescued each other. I fell in love with someone who is community and justice minded. In addition to her regular job, she's dedicated her life to various types of charitable fundraising in addition to pursuit of justice. As a young person, she went door to door to raise money for the St. Jude's Children's Research Hospital in Memphis. She has spent most of her adult life as an active member of the ncjw, which is the National Council of Jewish Women, which regularly performs, quote, miracles in the fields of social justice and providing aid for people in need, no matter their religion. Working with the NCJW, she collected signatures on the petition for Missouri's Amendment 3 for reproductive health freedom. She worked the polls on election day handing out literature for Democratic candidates. On a group visit to Israel last year during the time when prime minister tried to weaken the judiciary, she heard that there was going to be a protest in the area where she was staying. So she went out, bought an Israeli flag and joined the protest because of course she did. I sold my east coast home earlier this year and moved in with her in the Midwest. We got married a few months ago. In a previous message, my pod pet tax was photos of the mutt shepherd that my mom rescued from the New York subway. This time. Mhm. This time because I don't have a photo handy of any of my wife's late pups. I'm sending a photo of an example of the handiwork of Lucy, her black lab, who was known for lovingly altering towels and bath mats.

I am a first year Gen Xer who's been listening to you since the kitchen table days. I'd like to give a Shout out to my older sister, who I've always thought of as a hero, even though I don't think I've ever told her. She was the first female to graduate from the University of Florida with an electrical engineering degree and was, I think, the ninth female power engineer hired by the Los Angeles Department of Water and Power. She and her husband, also a power engineer, are retired and are, uh, avid cycling and skiing enthusiasts. She just came back from a cycling trip across Croatia and will soon be skiing in Japan. As she is quickly approaching a boomer milestone, she's planning her next excursion with, well, health permits, a bicycle ride from D.C. to Los Angeles. So, yeah, she's awesome as pod bet tax. I'd like to introduce you to my newest member of our family, Copper. We received Copper as a rescue from Tennessee just two weeks ago. Copper is an 8 to 12 month old sweetheart who has been through some trauma. We don't know the full story, but she and her siblings were given up when the son of the owner threatened to shoot them. We don't know for sure, but it's possible she witnessed some horror. For sure. She came from a violent home, she suffers from anxiety, and these past two weeks have been difficult. Trying to help her relax and know she's loved. After two weeks, she's just now starting to open up to my wife. Though I'm still a big scary to her. As she opens up, her personality is starting to show. She's a thief. She's stolen all of our other dog's toys. She's stolen treats out of my wife's coat pocket. She's torn a few things apart and good for her. She deserves some rebellious fun. We don't have DNA report, but we were just told at adoption time what she is. Can you guess?

 

Oh, wow. She looks like a retriever. Pyrenees.

 

Yeah, like a, uh, with golden in there. Maybe Ridgeback or Ozzie. What's that? She's got that kind of freckle face.

 

I know. Adorable. Yeah.

 

Maybe Ozzy Australian Shepherd. And maybe some great Pyrenees.
