After Marjorie Taylor Greene threatened to read the names of Epstein's co conspirators, Trump called her and yelled at her on speakerphone, saying, you'll hurt my friends. Tina Peters has asked the Colorado Appeals Court to recognize Trump's pardon and release her from prison. The ninth Circuit has blocked a lower court ruling that allowed teachers to out torture transgender students. That's a great news story. A postmark rule change could impact mail in voting this year. It's good to see you, too. Thanks for always covering me. I was traveling from one coast to the other, and I don't always plan my flight in a. In a way that works for our recording time. And we haven't figured out how I can record from the air yet, so here we are. It is nice to be back with you, my friend. Couple days left in 2025 and. Holy shit. It was a bad year for so many things, but not everything, but. But, man, it was a lot, a lot.

 

So glad it's almost. I know Our only good news is that bad things have been blocked temporarily by courts, and we're going to get into that in a minute, but, you know, it's all we can do when we don't have the majority anywhere and when the Supreme Court has been taken over by buttholes. So.

 

Yeah, yeah, well said, well said.

 

It's always a fight. It's just gonna keep being a fight. And it could have been so much easier, but, you know, could have been, should have been, but, we are here. We're where we're at. So I'm glad everybody's here listening, just listening and just, you know, getting the news, consuming the news, especially through independent media as an act of resistance. All right, we have tons to get to. You just you come back at the exact right time because there was a million things that happened.

 

I planned it.

 

I planned it since yesterday. So, let's do some quick hits.

 

And to make a long story short.

 

All right, there's supposed to be a hearing today for Brian Cole. That's the alleged January 6th pipe bomber and judge Box of wine Piro. And I've, I've covered this on, like, every platform I can think of. Has filed a detention motion. And, you know, back on December 4th or December 5th, they filed their arrest affidavit, and they're charging their charges on information which is not an indictment. A federal grand jury has not returned an indictment. But she filed her detention memo. She wants to hold Brian Cole in custody pending further, you know, action. And in that, she again left that 22 day gap of his whereabouts between December 15th and January 5th. Again, she didn't mention where he was on January 6th. They are so desperately trying to hide the fact that this guy is maga.

 

Yeah.

 

And an election denier. That they're screwing up their own criminal case. Like with the January 6th rioters under the Biden administration or the DOJ. When they filed an arrest affidavit, they would, first of all, they'd get a federal, grand jury to return an indictment within 14 days. They haven't here. And they would include all of their communications and whereabouts, especially after Donald Trump tweeted, come to the Capitol. January 6th will be wild. Which he did on December 19th. And you would get all of that leading up to and including what they did on January 5th, January 6th. And, you know, would have all that information which helps your case if you're trying to prosecute someone. But here, they're trying so desperately to hide what this guy's been doing that I'm, wondering if they're having a hard time getting a grand jury to indict him, because there isn't one yet. And Brian Cole's lawyers have filed a motion to make sure that the hearing happens today, December 30th. As you know, we record this on December 29th, but they're like, hey, we don't give you permission. The government, Dana wants to postpone this another week.

 

That's wild. And the lawyers, the lawyers are the ones that are like, nope, let's go, let's go.

 

Yeah, I don't. He's like, I don't give you permission. I get to have my hearing, you have to show probable cause to hold me because there's absent an indictment from a federal grand jury. You got to let me go if you can't prove probable cause to keep me here in prison while you continue to try to get your indictment. So it's just. It's interesting that they're going to step on their own dicks just to avoid having to admit that this guy is a Trump supporter.

 

Of course they are. Of course they are. Speaking of Trump supporters, this one's from the New York Times. This September, Greene spoke with several of Epstein's victims for the first time in a closed door House Oversight Committee meeting. After that hearing, Greene had a news conference. She held a news conference at which she threatened to identify some of the men who had abused the women. Just some. Now Trump called Greene to voice his displeasure. Greene was in her Capitol Hill office, and according to a staff member, everyone in the suite of rooms could hear him yelling at her as she listened to him on speakerphone. Because even though she's evil, apparently she's not stupid. So she put him on speakerphone. Greene says she expressed her perplexity over Trump's stubbornness on this specific subject. According to Greene, Trump replied, my friends will get hurt. Oh, I'm sorry. Your friends will. Your friends will get hurt. Piece of shit. When she urged Trump to invite some of Epstein's female victims to the Oval Office, she says he angrily informed her that they had done nothing to merit the honor. It would be the last conversation Greene and Trump would ever have. What a piece of shit. Yeah, this time I'm talking about Donald Trump.

 

Yeah, they're both pieces of shit.

 

I just want to make it clear, in this specific situation, Marjorie Taylor Greene is the lesser of two evils.

 

Yeah, she's still awful, but, that's why she's mad. Okay. One of the reasons that. And he told her she would never win a statewide election. And just in time for the 2026 primaries, everybody. Forbes reports that a recent change in post office processing rules is going to change the way postmarks work. The USPS has now clarified that most postmarks reflect the date of postal processing, not the date a, mail piece was deposited by the sender.

 

Oh, my God.

 

Yeah. So according to the post office, because most postmarks are applied at processing facilities, they don't necessarily represent either the place at which or the date on which the Postal Service first accepted possession of the mail piece. This means the date stamped by a postmark applied at a processing facility is going to be later than the date that the mail piece was first accepted by the Postal Service. Now, Forbes framed this as. This could make a problem with your IRS filings and your end of the year charitable activities. But it's mail in voting I'm worried about 100%.

 

Are you kidding me? If you got someone, even if you had a bad actor in a postal service that clearly saw that these were ballots and they just decided to, I don't know, sit on them for a day or two or, oh, we misplaced that entire batch. And look at that. It's after the date of voting, and you had to have it in two days ago. There could be so much fuckery here. I know it's not easy for a lot of people, and I know they're a hindrance, but if you are able, more than ever, it is important that you go vote in person. If you are able. And I know that is not everyone. But in the midterms, I'm telling you right now, I'm going to be one of those ones that normally mails in voting, either you do it far in advance. Far in advance would be a great idea. Or you walk in and vote in person. Do not wait till the day of and go, well, at least if it's postmarked by that date, I'm good to go. You're not going to be good to go in 2026.

 

Yeah. even this past election, last month, before this rule took effect, I deigned to drop my ballot in the mail. I went to a official ballot Dropbox.

 

Same.

 

So, yeah, if you're gonna use mail in voting, man, send it early. This is really gonna disenfranchise Democrats abroad. Anyone overseas? Yep, the military.

 

I could see people in Texas removing those boxes. The Dropbox, the official ones being like, oh, we don't know what happened to it, and just hoping people will, well, then I guess I'll take it to the post office and all the fuckery is going to go on at the post office.

 

Yeah. Then, by the way, this change published in the Federal Register on November 24, 2025, took effect on Christmas Eve.

 

Wow. Thank you. Thanks, Allison. All right. This one's from the Times. President Trump said in a radio interview that the United States had knocked out, and I quote, a big facility last week as part of his administration's campaign against Venezuela, an apparent reference to an American attack on a drug trafficking site. American officials. You know, I sound skeptical because I don't believe any of this shit, because it's about oil. American Officials said that Mr. Trump was referring to a drug facility in Venezuela and that it was eliminated but provided no details. Military officials said that they had no information to share and that the Central Intelligence Agency declined to comment. The White House also declined to comment. There has been no public record of an attack from the Venezuelan government or any other authorities in. In the region.

 

Yeah, so either he did a CIA covert op, so he could go around Congress, or he's just full of shit. And could be both, I think.

 

Well, we know he's full of shit, but it could be both. In this instance.

It's time for hot notes. Hot notes. And first up from the Colorado sun, former Colorado elections clerk and election denier Tina Peters is asking the state appeals court to recognize President Donald Trump's pardon of her state convictions as valid. In a motion Tuesday, Peters lawyer said the Colorado appeals court no longer has jurisdiction over her case because of a December 5 pardon issued by Donald Trump. They also asked the court to release her from prison. Because of the pardon, Peters, the former Mesa County, Colorado, clerk, was convicted of state crimes for orchestrating a data breach scheme driven by false claims about voting machine fraud in the 2020 presidential race. Trump's pardon power does not extend to state crimes. In the court filing, Peter's lawyers argued that President George Washington issued pardons to people convicted of state and federal crimes in the Whiskey Rebellion of 1795. And they urged it was. What was that? Was that about? It was about tariffs, wasn't it? Okay. They urged the state appeals court to issue a ruling quickly. The court is set to hear arguments from lawyers in Peter's appeal of her conviction on January 14th. The appeals court ruled Wednesday that lawyers from the state attorney general's office, which is defending the conviction, could respond to peters arguments by January 8th if they want. If the appeals court rules the pardon is not valid, one of Peters attorneys, Peter Tickton, said she could appeal the issue to the US Supreme Court while the state court continues to consider Peters appeal of her conviction. Another Peters attorney, John Case, has asked the state prison system to release Peters based on Trump's pardon, but the state refused, according to an email included in the appeals court filing. As you know, Peters was convicted of allowing a man to misuse a security card to access the election system and being deceptive about that person's identity. The man, by the way, was affiliated with MyPillow Chief Executive Mike Lindell, a prominent promoter of false claims and pillows. False claims that voting machines were manipulated to steal the election for Trump. He's running for governor of Minnesota and he thinks he has a chance.

 

Oh, my God. All right, this next one is from NBC. Russia on Monday promised to retaliate against Ukraine after it said nearly 100 drones had targeted one of President Vladimir Putin's residences, likely throwing a wrench into President Donald Trump's efforts to end the nearly four year war. And I quote, such reckless actions will not go unanswered. The targets for retaliatory strikes and the timing of their implementation by the Russian armed forces have been determined. This is from Russian Foreign Minister Lavrov said without offering detail of the alleged attacks in the region of Novgorod. Soon after Ukrainian President Volodymyr Zelensky called the claims a lie aimed at jeopardizing negotiations. Russia would most likely use the alleged attack to launch strikes at government buildings in Kyiv. As we know, that's the capital. This is what they said. Trump later told reporters that he just heard about the attack alleged by Russia. That would be too bad. That would not be good. He's very eloquent, he said ahead of his meeting with Israeli Prime Minister Bibi M. Netanyahu. Trump then then said that Putin had informed him of the alleged attack during a phone call that morning. He said it's one thing to be offensive. He said it's another thing to attack his house. It's not the right time to do any of that. I guess there's a right time for Trump. On Sunday, Trump was unusually optimistic about the peace process as he stood next to Zelensky at his Mar A Lago property in Florida. The Kremlin on Monday agreed with Trump's assessment that talks to end its war were in the final stage, even as it stuck to its hardline territorial demands. After nearly three hours behind closed doors on Sunday, Trump and Zelensky emerged to say that they were very close to a deal and 90% of the way there. I'm not sure if they emerged to say that or Trump said that, but it's those remaining, quote, one or two very thorny issues that will decide whether an agreement can be found between Kyiv and Moscow. This is all again from Trump. Don't believe any of it. We'll see what happens with the story.

 

Yeah, this is a Ah, this is a wag the dog. There was no attack on his residence. And a couple, like, we're very close. Just one or two very thorny issues. Yeah. That Ukraine doesn't want to hand Donbass over to Russia. That's a pretty big fucking thorny issue.

 

Yeah.

 

Like, yeah, we're super close, but we just don't want to give half our country to Russia. Like, oh, man.

 

All right, next up from KABC 7 Eyewitness News in Los Angeles. A federal judge has dismissed an indictment against a TikTok streamer shot by a federal agent in October in South Los Angeles. The judge says Carlitos Ricardo Parias, who goes by Richard LA Online, was denied access to his lawyers while he was held in detention. He also cites the government's failure to meet discovery deadlines. That's happening all over the place right now.

 

Yep.

 

Including the timely release of body camera footage in the shooting. They're also doing this to Lamonica, MacGyver and Harry, Dunn and I talk about this tomorrow, but apparently they're just now getting messages sent back and forth between agents about Lamonica MacIver's visit that happened back in May.

 

Oh, my God. Yeah.

 

And they don't have, a lot of the surveillance footage from the nearby cameras either. But back to this particular case that has just been dismissed. The shooting happened in the 400 block of East 20th street near Trinity street around 8:52 in the morning. Federal officials said it began as a targeted enforcement traffic stop on an undocumented immigrant who had previously avoided capture. Agents accused pariahs of ramming his car into their vehicles after they boxed him in. Sound familiar? This is always their story, but video from the scene raises questions about their claims. In other words, in a statement back In October, Trisha McLaughlin, she's the mouthpiece for DHS, said Paras, quote, weaponized his vehicle and began ramming the law enforcement vehicle in an attempt to flee. Fearing for the safety of the public and law enforcement, our officers followed their training and fired defensive shots. Now, this has happened so many times.

 

Yep.

 

Where they say people were in their vehicle, they tried to ram us, so we shot at them. And it's been proven every time now. This time, Pariahs was accused of ramming his Camry into law enforcement vehicles in front of and behind him after they boxed him in. First Assistant U.S. attorney Bill Asali, who's probably not legitimately a U.S. attorney, said Parias spun the car's tires, spewing smoke and debris into the air and causing the car to fishtail, causing agents to worry for their safety. How do you fish tail if you're boxed in? Assailee said an agent broke into his side window, but it wasn't enough to subdue Parias. That's when an agent opened fire. Parias was shot once in the elbow, and his deputy U.S. marshal was also shot in the hand by a ricochet bullet. Now, his trial was supposed to start, today, but the charges were dismissed. He was charged with assault on a federal officer. The judge dismissed the indictment with prejudice. And that's going to prevent prosecutors from refiling the same charges. So bad evidence video, proving him wrong. Judge dismissed the case before trial started today.

 

Thanks so much, Allison. And this one is from Aaron Reed at Aaron in the Morning. We love Aaron very much. Last week, a federal judge known for conservative decisions. This is Judge Roger Benitez. He ruled that California must allow schools and teachers to forcibly out transgender students to their parents. By the way, that's a decision that directly threatened to overturn California law protecting student privacy for LGBTQ students and prohibiting such mandatory disclosures that have been passed in a handful of school districts in the state. Now, just days later, the 9th Circuit has stepped in. This is a big fucking deal. A panel composed of Chief Judge Mary maguia and Judges Andrew Hurwitz and Salvador Mendoza. by the way, these are all Democratic appointees. They've all issued an initial order temporarily blocking the lower court's ruling, preserving the status quo while the case proceeds. Judge Benitez, that ruling, it's going to be blocked for at least the next week. This is according to the San Francisco Times. The ruling was issued on behalf of Thomas More Society. That's a Roman Catholic conservative nonprofit representing parents in the Escondido School District, which had adopted a forced outing policy. What the fuck? While the lower court judge ruled that the district must allow schools to forcibly out students to their parents when a student is transgender. That decision is now paused as the state of California presents its case before the Court of Appeals. And I see so many problems with this. Ah, so many problems with this. But this is a quote from the story. Judge Benitez's dangerous ruling goes far beyond the Safety act and broadly targets numerous California laws and protections for transgender and gender non conforming students, attempting to invalidate critical safeguards that prevent forced outing and allow educators to respect students affirmed name and pronouns in school. These protections exist for one reason. To keep students safe and ensure schools remain places where young people can learn and thrive without fear. This is From Equality California. They said that in a statement following the initial ruling. Forced outing is a harmful practice. The Trevor Project reports that LGBTQ youth in schools with forced outing and other anti trans policies report significantly higher rates of anxiety, depression, and suicide attempts. Another study by UConn Reports, and I quote, the team found that respondents who were outed, about 30% of them to their parents, were more likely to experience elevated depression symptoms and lower LGBTQ family support compared to those who were not. Parents who affirmed and supported their child's identity could potentially mitigate depressive symptoms from the stress of being outed. Importantly, not every family is supportive. And forced outing often leads to transgender youth being forced outside of their home or abused. This is all statistically proven. The block, however, in this situation, is only temporary as the case moves forward. Still, the composition of the appellate panel, it offers transgender students a measure of relief. All three judges were appointed by Democratic presidents, increasing the likelihood that California's protections against forced outing, that they are going to remain in place for now. That relief, it may be short lived, given the Supreme Court's repeated willingness to intervene in cases involving transgender rights, especially to revive policies advanced by conservative judges. Further review is going to happen. It's going to happen. Someone's going to try and take the septoscotis. Regardless of the outcome, this case is poised to reach far beyond California, shaping the future of whether states can protect transgender students from being forcibly outed by their schools.

Hello, beans, Queens. I just spent last week in Minnesota looking for my next residence and visiting family for the holiday. I went there to, quote, experience the winter and happened into an unusually temperate week. Hanging out in the 30s instead of the 20s or worse still, we found places we liked and more we didn't on Christmas Eve pagnostic myself, but celebrate with family just the same. We went to the Minnesota Zoo and it was a nice visit. Their mission is to focus on conservation and education and I was impressed by the way it was laid out and all the information they provided to everyone. Luckily, it was a bit chilly in the wind. So the kids were mostly inside. I'm not a parent. Lol. it of so with you. This visit brings me to my point for writing. The zoo had a red panda section and these babies were so cute, I had to share. I hope you enjoy them. Thanks for all you do, ladies. And I truly appreciate the Daily Beans Unjustified and clean up on L45. Also, thank you for sharing and producing the Martin Sheen Podcast.
